Will of Simon Young Senior

Last Will and Testament of
Simon Young Sr of Twillingate N.D.
Planter deceased.

      This is the last will and Testament of me Simon Young Senior of Twillingate Newfoundland Planter.

First. I give devise and bequeath my schooner "Six Brothers" of Twillingate with all her gear and appurtenances belonging. Also my lands and Fishing Rooms on South Island Twillingate including the stages, stores and flakes and all the fishing gear in my possession or may hereafter have in equal shares to my five sons viz. Philip, James, Joseph, William and Simon for their own use and benefit.

Secondly. I give devise and bequeath to my son Joseph Young for his own use and benefit my dwelling house in which I now reside and the land on which it now stands also all the furniture with all and every appurtenances and materials therein.

Thirdly. I give devise and bequeath to my wife Eve Young for her absolute use and benefit all the money in gold coin now in my house about Five hundred and sixty dollars for her use and to dispose hereafter as she may think proper

Fourthly. I give devise and bequeath to my four daughters viz Jane Liscombe wife of Thomas of Loon Bay, Susan Cooke wife of Peter of North Island Twillingate, Ellen House wife of Frederick of North Island and Lucy Stockley wife of Robert Stockley of Hapts Cove South Island Twillingate in equal shares, whatever monies may accrue from my deposit receipt for Four thousand dollars in the Commercial Bank, with the interest thereon up to date of the Insolvency of the said Bank at St. John's Newfoundland the dividend arising therefrom to be divided in equal shares amongst my four daughters within named.

Fifthly I give devise and bequeath to my son Peter Young the amount of my credit note for eight hundred dollars at interest in the firm of Edwin Duder at Twillingate also the balance due me on account to the twenty third day of November A.D. 1894 of Three hundred and ninety eight dollars and forty six cents, also from the said Twillingate firm of Edwin Duder the dividend accruing from the Insolvent Estate being for his own use and benefit

Sixthly. I give devise and bequeath to my five sons Philip James Joseph William and Simon in equal shares whatever money may accrue out of the amount of money about seven hundred dollars from the Insolvent estate of Edwin Duder at St. John's Newfoundland in equal shares also the amount of two hundred and forty dollars due me by Matthew Elliott of South Island on the Schooner now in his possession for the use and benefit of my said within named five sons in equal shares.

Seventhly. The money one hundred dollars lent by me to Mr. Richard Dorman Hodge of North Island in the fall of 1894 previous to his Insolvency, when collected it is my request that the said amount be paid over to my wife Eve Young.

And I appoint Frederick Irvin Stafford M.D. and Francis Berteau Esqr. Stpdy Magistrate both of Twillingate Executors of this my sole and only will. In witness whereof I hereunto set my hand this thirteenth day of May in the year of our Lord one thousand eight hundred and ninety five (sgd) Simon his x mark Young Senior. Signed by the said Simon Young the Testator by affixing his mark thereto in our presence who in the presence of each other at the same time subscribed our names as witnesses. (Sgd) William Hitchcock Clerk at Twillingate. (Sgd) Edwin Hodder of Twillingate Cooper.

Codicil

I Simon Young Senior, planter of Twillingate do make this codicil to this my will of this date. Whereas I have in my will section four bequeathed to my four daughters named in my will that whatever monies may accrue from the four thousand dollars deposit receipt in the Commercial Bank of St. John's now Insolvent Now I revoke that part of the fourth section so far as relates to the legacy of my said daughters. Now I do hereby give and bequeath to my wife Eve Young one half of the monies accruing from the Commercial Bank Deposit for her own use and benefit, the other half accruing therefrom to my four daughters named in this my will in equal shares for their own use and benefit and in all other respects I confirm my will. In witness whereof I hereunto set my hand this Thirteenth day of May in the year of our Lord one thousand eight hundred and ninety five. (Sgd) Simon his x mark Young Senior. Signed by the said Simon Young the Testator by affixing his mark thereto in our presence who in his presence and in the presence of each other at the same time subscribe our names as witnesses. (Sgd) William Hitchcock of Twillingate Clerk (sgd) Edwin Hodder of Twillingate Cooper.

      I certify the foregoing to be a correct copy of the last will and Testament and Codicil of Simon Young Sr deceased
