IN RE. DECEASED
THOMAS WINTER
THIS IS THE LAST WILL AND TESTAMENT of me Thomas Winter of St. John's in the Dominion of Newfoundland, Accountant.
FIRST. I hereby revoke all former wills and testamentary dispositions by me at any time made and declare this to be my last will and testament. Second. I direct that my just debts funeral and testamentary expenses and death duties be first paid out of my estate. THIRD. Subject to the provisions of the last preceding paragraph I give and bequeath the whole of my estate of whatsoever kind or wheresoever situate unto my Executors in trust to realise the same as soon after my death as my executors shall deem expedient and invest the proceeds in such manner as my said Executors shall decide and hold the same in trust for a period of ten years from my decease to pay to my two daughters, Marion, wife of Charles Ford, and Florence in equal shares ( or their respective children should either of my said daughters die in the meantime leaving issue) from the income therefrom such amounts at such times and in such times and in such manner for the support and maintenance of my said daughters or the education of their children as my Executors in their absolute discretion shall decide. Upon the expiration of the said period of ten years I direct that the residue of my estate shall be divided equally between my said two daughters, the children, if any, of a deceased child taking their parents share. FOURTH. Should either of my said daughters predecease me without leaving issue or die without leaving issue before the expiration of the said period of ten years I direct that my Executors shall stand possessed of the whole of the income of my estate in trust to pay to my surviving daughter, or her children, if any, in the event of her prior deceased, such amounts as they in their absolute discretion shall consider necessary for her support and maintenance and the education of her children, if any, until the expiration of the said period of ten years. Fifth. I direct that my executors shall be at liberty in their absolute discretion before the expiration of the said period of ten years on being satisfied as to the necessity for the same to advance to either of my said legatees who shall make application to them thereof, such sums from time to time from the capital of my estate as my executors may deem expedient, such advances to be taken into account in the final distribution of my estate. SIXTH. I appoint my brother Sir Marmaduke G. Winter and the Eastern Trust Company Executors of this my last will and testament.
