Will of James Jennings Winsor from Newfoundland will books volume 5 page 527-528 probate year 1890 - 1897 Last will and testament This is the last will and testament of me James Jennings Winsor, of St. John's in the Island of Newfoundland, Master Mariner hereby revoking all former wills by me made. First. I direct that all my just debts and funeral expenses be paid. Secondly I give to my dear wife Mary the sum of four thousand dollars to her sole and separate use. Thirdly. I give the sum of four hundred dollars to each of my brothers and to each of my sisters to her sole and separate use, the children of a deceased brother or sister to represent the deceased parent. Fourthly. I give to my dear wife and mother the house I now live in and the ground adjoining thereto together with all my household furniture jointly with benefit of survivorship during the life of such survivor. Fifthly. All the residue of my estate and of all property whatsoever I give to my executors hereafter named and the survivor of them upon trust to and for the sole use and behoof of my dear wife and mother and the survivor of them during the life of such survivor. Sixthly after the decease of my said dear wife and mother I will and direct that all the said residue of my estate and of all property referred to in the foregoing fifth clause of this my will and also the house grounds and household furniture referred to in the foregoing fourth clause of this my will shall be divided and apportioned by my executors or the survivors of them share and share alike among and between my brothers and sisters, the children of a deceased brother or sister to represent the deceased parent and each sister's share to be secured to her sole and separate use and for the purposes of such division and appointment the said executors and the survivors of them are authorized hereby to sell all or any part of the said property to be divided and to divide the proceeds or to divide the property itself. Seventhly. If at the time of my decease any or either of my brothers or sisters are or is indebted to me I hereby forgive to him her or their such indebtedness and release him her and them from the payment of the same. Eighthly. I nominate and appoint my dear wife Mary and my friend William V. Whiteway of St. John's Barrister to be the executors of this my will. St. John's Newfoundland March the twenty second anno Domini eighteen hundred and seventy. James Jennings Winsor (L.S.) Signed sealed published and declared by the said James Jennings Winsor as and for my last will and testament in presence of the undersigned witnesses who in the presence of each other and in the presence of me the said James Jennings Winsor have subscribed hereto their names as witnesses to the due execution of these presents the words "the true and lawful" in this page being first erased.
