Will of Jane Windle from Newfoundland will books volume 14 pages 117-119 probate year 1927 In re I JANE WINDLE the wife of John Thomas Windle of Foulridge Melbourne Place
Horton in the City of Bradford declare this to be my last will which I make
this first day of July one thousand nine hundred and twenty five hereby revoking
all other wills and testamentary dispositions heretofore made by me I appoint
my husband John Thomas Windle and my son John Lightfoot Windle (hereinafter
called "my trustees") to be the EXECUTORS and Trustees of this my will I give
devise and bequeath all my real and personal property not otherwise disposed
of by this my will or any codicil hereto to my trustees on the trusts hereinafter
declared concerning the same that is to say Upon trust that my trustees shall
sell call in collect and convert into money the said real and personal property
at such time or times and in such manner as they shall think fit with power
to postpone the sale calling in or conversion of the whole or any part thereof
during such period as they shall think proper and to retain the same or any
part thereof in its present form of investment without being responsible for
loss My trustees shall out of the moneys to arise from such sale calling in
or conversion of or forming part of my said real and personal property pay
my funeral and testamentary expenses and debts and the legacies given by this
my will or any codicil hereto My trustees shall at their discretion invest
the residue of the said moneys (which moneys After the death of my said husband My trustees shall
stand possessed of the capital and future income of the Trust fund In trust
for all or any my children or child who being male attain the age of twenty
one years or being female attain that age or marry if more than one in equal
shares Provided always that the share of the trust fund hereinbefore given
to any daughter of mine shall not vest absolutely in such daughter but shall
be retained by my trustees and held by them upon the trusts hereinafter declared
concerning the same respectively that is to say during the life of such daughter
my trustees shall pay the income of such share to her so that during coverture
the same shall be without power of anticipation After the death of such daughter
my trustees shall hold such share and the future income thereof In trust for
all or such one or more exclusively of the others or other of the children
or remoter issue of such daughter at such age or time or respective ages or
times if more than one in such shares and with such trusts for their respective
benefit and such provision for their respective advancement and maintenance
and education at the discretion of my trustees or any other person or persons
as such said daughter shall by any deed or deeds revocable or irrevocable or
by Will or codicil appoint And in default of any such appointment In trust
for all or any the children or child of such daughter who shall be living at
my death or born afterwards and who being male attain the age of twenty one
years or being female attain that age or marry and if more than one in equal
shares Provided always that if the trusts hereinbefore declared concerning
any such daughter shall fail then subject to the trusts powers and provisions
hereinbefore declared and contained and to the powers by law vested in my trustees
and to every of any exercise of such powers My trustees shall hold the share
of such daughter In trust for my said son John Lightfoot IN WITNESS whereof
I have hereunto set my hand the day and year first hereinbefore written - THIS IS A CODICIL to my above written will which I make this twelfth day of
November one thousand nine hundred and twenty five I bequeath to my niece Mary
Alice the daughter of my deceased brother William and the wife of Alfred Boston the sum of one thousand pounds free of duty if she shall be living at the death
of my said husband and in all other respects I confirm my said will
