Last Will and Testament of
Mary Ann Williams of Bay Bulls
Widow deceased.
This is the last will and Testament of me Mary
Ann Williams of Bread and Cheese Cove, Bay Bulls but at present of Saint John's
widow.
First I will and direct that my executor hereinafter named
shall first pay out of my general estate all my just debts and Funeral and
Testamentary expenses. Second. I give devise and bequeath to my daughter
Lydia wife of William Guswell of Saint John's farmer the dwelling house situate
on the north side of water street west Saint John's now occupied by her together
with the garden in the rear thereof to hold the same to the said Lydia
Guswell for and during the term of her natural life and after the death of my said
daughter Lydia I give devise and bequeath the same dwelling house and premises
to my granddaughter Ada Guswell and in the event of the death of the said Ada
Guswell without issue then to my grandchildren James, Jessie
and William children
of my said daughter Lydia in equal proportions as tenants in common.
Third.
I give devise and bequeath to my said daughter Lydia all my
share estate right title and interest in and to the premises situate on Water
street in the Town of Saint John's now in the occupancy of James Angel & Co.
and known as the "Victoria Engine and Boiler Works" to hold the same for and
during her natural life and after her decease I give devise and bequeath the
same to my grandson William Guswell son of my said daughter Lydia and in the
event of the death of my said grandson William without issue I give devise
and bequeath the same to my grandson James Guswell also son of my said daughter Lydia.
Fourth.
I give devise and bequeath all my share estate right and interest in and to
that property situate on Water street in the Town of Saint John's now occupied
by Messrs P & L Tessier and known as Hounsell's to my granddaughter Jessie
Guswell subject to the life interest therein of my said daughter Lydia
Guswell as in the before mentioned properties. In the event of the death of my said
granddaughter Jessie without issue I give and bequeath the same to my said
granddaughter Ada.
Fifth. I give devise and bequeath to my said daughter
Lydia my dwelling house kitchen garden and stable in the rear situate at Bread
and Cheese Cove Bay Bulls for and during her natural life and after her decease
I give and bequeath the same to my grandson James Guswell.
Sixth.
I give devise and bequeath the dwelling house and premises situate on the North
side of Water street west Saint John's now occupied by one Eagan (Baker) to
my daughter Mary Grace wife of Thomas Williams of Bay Bulls aforesaid, and
after the death of my said daughter Mary Grace to Jessie
Williams my granddaughter
and daughter of the said Mary Grace Williams. Should the said Jessie
Williams die without issue it is my will and I do direct that this property shall become
the property of my next of kin then surviving.
Seventh. It is my
will and I do direct that no part of my property and estate hereinbefore bequeathed
shall at any time be sold or otherwise disposed of by the legatees aforesaid,
except the bequest by me made to my grandson James Guswell of the Property
at Bay Bulls which he may dispose of if he see fit.
Eighth. I hereby
appoint John Henry Williams of Bread and Cheese Bay Bulls
aforesaid to be the sole executor of this my last will and Testament. Dated
at Saint John's this fifteenth day of December A.D. eighteen hundred and ninety
one. (Sgd) M.
A. Williams. Signed published and declared by the said Testatrix in
the presence of us who in her presence and the presence of each other both
present at the same time, and at her request, have hereto subscribed our names
as witnesses. (Sgd) Caroline Payne. (Sgd) J. J. Pitman.
I certify the foregoing to be a correct
copy of the last will and Testament of Mary A. Williams deceased
