Will of Benjamin Wilcox
from Newfoundland will books volume 7 pages 50-52 probate year 1901

Last Will and Testament of
Benjamin Wilcox of Bay Roberts
Planter deceased.

      In the name of God Amen. I Benjamin Wilcox of Bay Roberts Nfld. Planter, being of sound and disposing mind and memory do make and publish this as my last will and testament. I hereby appoint A. W. Piccott and John Acreman to be the executors of my will. I hereby direct my executors to see that this my last will and testament is lawfully enforced I hereby bequeath to my only son Archibald Wilcox all my real and personal property namely, my house shop barn horse cow with all my land. Also my fishing gear to be his for his personal use but if he should sell said fishing gear the money received for same to be eaqueal divided between my wife Emma Wilcox & my daughters Laura & Grace Wilcox with Archibald Wilcox my son.
I hereby bequeath to my wife Emma Wilcox and my daughters Laura and Grace Wilcox the right to live in the house with my son Archibald Wilcox as long as they remain unmarried and that they are to have the use of all the cultivated land also the use of horse & cow and that my daughter Laura Wilcox with my wife Emma Wilcox will have full control of the business connected with the shop as long as they remain to live together with my son Archibald Wilcox.
I hereby bequeath to my son Archibald Wilcox our sewing machine but as long as my wife Emma Wilcox and my daughters Laura and Gracie Wilcox remains unmarried and members of the family they are to have the use of said sewing machine with all other articles of my house. If my wife Emma Wilcox leaves my house that I have bequeathed to my son Archibald Wilcox she is to take with her and have for herself the bed and all the bed clothing thereoff wich we know use.
I hereby bequeath my money wich is in diffrent banks at St. John's Nfld. To be divided as follows namely to my wife Emma Wilcox I bequeath one hundred and fifty dollars $150.00 To my eldest daughter Edna, "which is now at British Columbia", I bequeath thirty dollars $30.00 To my son Archibald Wilcox I bequeath one hundred dollars $100.00 and to my daughter Laura Wilcox I bequeath Fifty dollars $50.00 and to my youngest daughter Gracie Wilcox when she arives at the full age of eighteen she is to receive the sum of twenty dollars $20.00 the balance of my money left at St. John's hafter this is shared will be about forty dollars $40.00 it will be given to my wife Emma Wilcox to be used by her for the benefit of all my family.
If after my deceas there should arise any grievances between my wife Emma Wilcox and my children she is to have for her own perosnal and private use the Bed Room wich we know occupy and the Room beneath it namely the dining room and a right to use the front door and halls and my daughter Laura Wilcox is to live with my wife Emma Wilcox if she should wish to do so.
As this is my last will and Testament it his my wish and desire that my wife Emma Wilcox and my children live together in peace and try by the help of God to comfort one another and if my wife Emma Wilcox and my daughters Laura and Gracie Wilcox leaves this house or gets married my house with all other things belog to me shall become my sons Archibald Wilcoxs. If it should be Gods will to remove by death my son Archibald Wilcox withough issue. This house with all other house and land belong to me to become my daughters. Signed sealed and declared by said Benjamin Wilcox of Benjamin as and for his last will and Testament in the presence of us present at the same time, who at his request, in his presence and the presence of each other have hereunto subscribed our names as witnesses to the due execution hereof his name Benjamin Wilcox witness (sgd) A. W. Piccott. (Sgd) John Acreman.
Bay Roberts 16th January 1901.

      I Benjamin Wilcox do hear & know on this 28th day of January 1901 in the presence of A.W. Piccott and John Acreman alter my last will and Testemt where it reads but if he Archibald Wilcox should sell said Fishing gear, the money received for same to be equel divided between my wife Emma Wilcox and my daughters Laura and Gracey Wilcox and my son Archibald Wilcox. It is my wish and I hereby bequeath to my only son Archibald Wilcox that if such fishing gear be sold or hired that the money received for same be used for the maintenance of my wife Emma Wilcox and my daughters Laura & Gracie Wilcox with my only son Archibald Wilcox as long as they remain to live in my house wich I bequeath to my only son Archibald Wilcox.       I certify the foregoing to be a correct copy of the last will and Testament and codicil of Benjamin Wilcox deceased
