IN RE. DECEASED
WILLIAM WHITEWAY (OF WILLIAM)
This is the last will and testament of me William Whiteway (of Wm) of Jobs Cove Bay de Verde Nfld made this 19th day of January 1927 and by this will I annul all other wills and testaments made by me being in full power of all my reasoning faculties but growing old and well advanced in life I am conscious that I must soon die. I desire to appropriate my worldly possessions as follows:-
1st. To my son William George Whiteway I bequeath all and sundries of what he now occupies and that I have put him in possession with an equal part with his brothers of our joint fishing room property to be his and his heirs executors and assigns forever.
2nd. To my son David Whiteway the portion of the inside property cultivated and wooded land with all erections thereon that he now occupies to the extent of which I will define set apart and mark out for him with an equal part with his brothers of the fishing room property to his heirs and assigns forever.
3rd. To my son Douglas Whiteway the whole of my brother Robert Whiteways property whatever and wherever situated that my Bro Robert bequeathed to me with the proviso that he is not to give sell or transfer it at any time in future outside the Whiteway name or family to be his and his direct heirs with an equal part of the fishing room property with his brothers forever.
4th. To my wife Rosanna Whiteway during her lifetime or she remains my widow all the residue of my property real and personal whatever and wheresoever situated apart from the former bequests in this document provided that she is not to sell transfer or give away any or anything out of the family name nor from our son John Whiteway who is to be the sole heir after his mother Rosanna Whiteway to the whole residue of my property held and occupied at the time of this writing by me and his mother to be John's before mentioned his heirs executors and assigns forever. If John die without heirs or assigns, the whole after the death of my wife Rosanna is to be equally divided among the living sons mentioned and named before herein.
I hereby name my son David Whiteway and my son John Whiteway as executors to this my last will and testament and hereto I set my name and seal this 19th day of January 1927
