Last will and testament
of Ann Whelan
of St. John's widow Deceased.
In the name of God Amen. I Ann Whelan of St. John's in the island of Newfoundland widow do make publish and declare as and for my last will and testament this paper writing. First I give and bequeath to my daughter Mary Ann the house I now live in up and down stairs and the house next to it at present occupied by William Davis up and down stairs together with the land belonging to said houses and also the dwelling house occupied by Walsh up and down stairs with the land and also the house occupied by Chafter and Rusk with the land. I further give and bequeath to my daughter Mary Ann all my lands goods debts credits chattels monies and effects not before mentioned, all for her own use and benefit and not in any way to be subject to the debts or control of any husband she may have.
I give and bequeath to my son Peter Whelan the house occupied by one Berry, the house occupied by Harrington and also Bills house together with the land. The same is not to be sold or mortgaged and if the said Peter Whelan should die then the said houses and land hereby bequeathed to him are to be shared, share and share alike amongst his children, that is, my grandchildren and if they should die then to my daughter Mary Ann the said dwelling houses lands and tenements bequeathed by me to my said daughter are not to be sold or mortgaged the piece of ground between Landy's and Daniel Harringtons I also give to my son Peter but it is not be to sold or mortgaged but to be dealt with as by other bequests to him of house and land. The double house occupied by Mrs. Morrissey and Mrs. Mullowney I give and bequeath to my grandson Michael Finn and the little house known as Mrs. Gormans I give to said Michael Finn and the land from the house to Mrs. Landy I give to Michael Finn the same is not to be sold or mortgaged. He is to have also my bed and bedding.
I direct that four pounds be paid yearly for ten years for masses for my soul and the soul of my mother Ellen Gorman the same to be paid for my executrix out of my whole estate and the rents therefrom and I direct and strictly enforce the bequest as a first charge on my estate. The whole of the rents and profits of the whole of my estate are to be received by my daughter Mary Ann for the period of five years after my decease. I direct that my funeral expenses and debts be paid also out of the whole rents and profits of my said estate and before any division. I revoke all other wills by me made and I declare this to be my last will and testament. I appoint my daughter Mary Ann as executrix to this my last will and testament In witness whereof I have hereunto fixed my name by placing my mark thereto. Ann her x mark Whelan.
Signed published and declared as and for the last will and testament of Ann Whelan at St. John's in the island of Newfoundland in the presence of us and in the presence of each other (the same having been first read over and explained to the said Ann Whelan) this 12th day of January A.D. 1885.
