from Newfoundland will books volume 6 pages 248-249 probate year 1895

Last Will and Testament of
Philip Way of Bird Island Cove, Trinity Bay
Fisherman deceased.

      In the name of God Amen this seventh day of September one thousand eight hundred and eighty nine. I Philip Way Senr of Bird Island Cove being in perfect health of body and of perfect mind and memory and knowing that it is appointed unto all men once to die do make and ordain this my last will and Testament that is to say: I give to my son Mark Way the whole garden said garden being bounded by the Bonavista Road upon the East side by Richard Rendells house upon the west side and by Robert Crews garden upon the west north west side. I do also give to my son Mark my house cellar and the entire garden which the house is surrounded by I give to my son Mark the garden in the rear of the house said garden being bounded by Robert Bakers garden on the south side and a lane on the west side I also give to my son Mark my pit saw and I do freely and of my own accord give the aforementioned house cellar gardens saw and so forth to my son Mark Way wholly to be his own. I give to my son Archibald Way the stable and land surrounding it and the entire garden where his house stands said garden being bounded by the main road on the south east and by Joseph Chaulks garden on the west north west side and I do hereby utterly disallow revoke and disannul all and every former Testament, will legacy, bequest or execution and I do hereby ratify and confirm this and no other to be my last will and Testament in witness whereof I have hereunto set my hand and seal this seventh day of September in the year of our Lord one thousand eight hundred and eighty nine. (Sgd) Philip his x mark Way (LS) Signed Sealed published pronounced and declared by the said Philip Way Senr. as his last will and Testament in the presence of each other by his request who have hereunto subscribed our names as witnesses.
