Will of Susannah Warne
from Newfoundland will books volume 1 pages 75 & 76 probate year 1829.

In the Estate of
     Susannah Warne       deceased.

In the Name of God Amen, I Susannah Warne late of the Town and County of Poole in Dorsetshire England Widow and relict of James Warne of Saint John's Newfoundland, Mariner, my late husband deceased, being of sound memory and understanding, but weak in body, make this my last will and testament as follows, that is to say, I give and bequeath, subject to the payment of my just debts, funeral expenses and the Probate and execution of this my last will, all my property whether real or personal of what nature and kind soever in Newfoundland and in England unto Newman Wright Hoyles and Charles James Fox Bennett of Saint John's aforesaid, their executors, administrators and assigns Upon Trust that they my said Trustees their and every of their executors, administrators and assigns, shall and will, yearly and every year during the life of my beloved daughter Susannah Weston Haire pay or cause to be paid all the rents profits and produce of my real and personal estate in Newfoundland and England aforesaid, into the proper hands of her the said Susannah Weston Haire and for her own sole separate use and benefit, or to such person or persons as she by any writing signed with her proper hand shall from time to time notwithstanding her present or any future coverture, direct or appoint. And my Will is that her present or any future husband shall not intermeddle therewith neither shall the same be subject or liable to his control debts or engagements And the receipt of her the said Susannah Weston Haire, signed with her proper hand shall be a good and sufficient discharge for so much of the rents and profits of my said estate as shall be therein acknowledged and expressed to be received. And further my will is, that after the decease of my said beloved daughter Susannah Weston Haire that the residue of my property as aforesaid be equally divided, in just proportions, between the female children of her the said Susannah Weston Haire, on her body begotten by her present husband Alexander Haire or to be begotten. And lastly I do hereby nominate constitute and appoint Newman Wright Hoyles and Charles James Fox Bennett aforenamed my executors and Susannah Weston Haire aforenamed my executrix of this my last will and testament, and do hereby revoke and make void all former and other will and wills by me at any time heretofore made, and do declare this to be my last will and testament
In witness whereof I the said Susannah Warne have hereunto set my hand and seal this sixth day of February in the year of our Lord one thousand eight hundred and twenty three. Susa. Warne (LS)
Signed sealed declared and published at St. John's Newfoundland by the abovenamed Susannah Warne as and for her last will and testament in the Presence of us, who at her request and in her presence have subscribed our names as witnesses hereto. Frederick H. Carrington.   J. Beacon.   A. Hogsett.
Notwithstanding my last will and testament preceding I do hereby give unto Henry James Jackson the lawful son of my said daughter Susannah Weston Haire by her former husband Henry Miller Jackson deceased an eight-day Clock and a double chest of drawers now in the possession of my sister Mary Furber residing in the Town and County of Poole Dorsetshire England. Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
