Will of Thomas Walsh from Newfoundland will books volume 5 pages 106-107 probate year 1887
The last will and Testament of Thomas Walsh late of Saint John's Farmer.
I Thomas Walsh of Upper Long Pond Road in St. John's in the Island of Newfoundland Farmer do make publish and declare this to be my last will and Testament and I hereby annul all former wills by me made or executed. I give and bequeath unto Mary Ann Walsh and Thomas Walsh children of Martin and Ellen Walsh who now live on the farm with me all my land on both sides of the Pond aforesaid Dwelling house, outhouses barns and all other property consisting of horses cattle crops houses or otherwise carts implements of agriculture household furniture and other property I may die possessed of and not herein enumerated for their and each of their sole and absolute use for ever subject to the conditions following that is to say that the sum of eight dollars shall be paid annually for masses for the repose of the soul of my wife Anastatia and for the repose of my soul.
And it is my will and I hereby direct my executors in case default shall be made in the payment of such sum of eight dollars for masses as aforesaid to sell the land on the west side of the Pond aforesaid and from the proceeds of such sale to pay the annual sum then due for masses as aforesaid and the balance of such sale of land to be kept and invested for the payment for masses aforesaid.
It is further my will and I hereby direct that no part of the land or premises herein bequeathed shall be sold or mortgaged and in case the said Mary Ann Walsh and Thomas Walsh shall leave or live elsewhere then on the farm aforesaid then and in such the farm is hereby devised and bequeathed to and for the use of the Roman Catholic Orphanage but in case either of the said children shall continue on the farm then he or she becomes the sole owner.
Lastly I hereby nominate and appoint John Quirk of Georges Town and John Dwyer of Oak Farm executors of this my last will and Testament
In witness whereof I have hereunto my hand subscribed at St. John's aforesaid this third day of March A.D. 1879 - Thomas his x mark Walsh. Signed published and declared by the said Thomas Walsh as and for his last will and Testament in presence of us and each of us who have hereunto subscribed our names as witnesses as his request. M.
