Will of Robert Walsh from Newfoundland will books volume 5 page 592-593 probate year 1891 Last will and testament Know all men by these presents that I Robert Walsh of Harbor Grace in the Island of Newfoundland do make and ordain this to be my last will and testament All my lawful debts having been first paid 1st. I give devise and bequeath to my eldest son Patrick and his heirs, my farm together with all buildings stock and farming utensils thereon free from all incumbrance, or contribution, to any other bequest (made) by me; also the yearly sum of fifteen pounds currency to be paid to my said son Patrick during his natural life out of the rents or issues of my other property. In the event of the house at present occupied by me being destroyed by fire, said yearly legacy of fifteen pounds currency shall cease, and the sum of one hundred pounds currency shall be paid to my said son Patrick in lieu of any further claim on my estate. 2nd. I give devise and bequeath to my daughter Agnes, who is about entering a convent at Halifax the yearly sum of twenty five pounds currency during her natural life, to be taken from the rents or issues of the house at present occupied by Hippisley. 3rd. I give devise and bequeath to my daughters Mary and Lizzie and their heirs, the house and property at present occupied by Hippisley free from any reduction or contribution to any other bequest made by me; but if my daughter Agnes should enter or remain in the Convent, she shall participate and have an equal and similar interest with my other daughters Mary and Lizzie, in the property hereby bequeathed, or that hereafter in any way may revert to them. 4th. I give devise and bequeath to my son Robert during his natural life the yearly sum of twenty pounds currency, to be paid to him out of the rents and issues from my estate, but in the event of the house at present occupied by me being destroyed by fire, said bequest of twenty pounds shall cease. 5th. I give devise and bequeath to my sons Frances Robert and their heirs the residue of my landed property and houses not otherwise bequeathed. 6th. I give devise and bequeath to the Irish Society of Conception Bay, of which I have the honour of being president, the yearly sum of one pound currency to be paid out of my estate. 7th. I give devise and bequeath the sum of fifty pounds currency, derivable from the rents and issues of my estate to be distributed by my executors among charitable institutions. 8th. I do hereby will and ordain that no division whatever of my property shall be made during my wife's lifetime, nor shall any bequests come into operation with the exception of those named in clauses six (6) and seven (7) but that all shall be and remain for my said wife's benefit and support, also that none of my landed property or houses shall be either sold, mortgaged or subject to any liabilities whatever that may be in incurred by my legatees, and that all shall be kept insured 9th. I do hereby will and ordain that in the event of the death of either of my daughters, Mary and Lizzie without lawful issue, said deceased daughter's share of the property hereinbefore bequeathed to them, shall revert to my other surviving daughters and her heirs, but in the event of both of my daughters Mary and Lizzie dying without lawful issue, said property shall revert to my daughter Agnes, if she should not remain in the Convent, but if my said daughter Agnes should enter and remain in the Convent said property shall revert to my sons Thomas and Robert and their heirs subject to the yearly sum of twenty five pounds currency hereinbefore described and bequeathed to my said daughter Agnes. In the event of the death of either of my sons Thomas or Robert without lawful issue said deceased son's share shall revert to my other surviving son (whether Thomas or Robert) and his heirs, and my surviving daughter or daughters and their heirs. 10th. I do hereby ordain, constitute and appoint my son Thomas and James Bolger to be executors of this my last will and testament. As witness my hand at Harbor Grace aforesaid this twenty ninth day of February in the year of our Lord one thousand eight hundred and seventy six. Robert Walsh.
