Will of John Walsh
from the Newfoundland will books volume 12 page 170 probate year 1922

In re JOHN WALSH.      DECEASED.

This is the last Will and Testament of James Walsh of Broad Cove Bonavista Bay Newfoundland, District of Bonavista. I hereby give devise and bequeath to my wife, Bridget Walsh of Broad Cove Bonavista Bay Newfoundland, absolutely and forever all my estate and effects both real and personal in the following manner.

  • FIRST I give devise and bequeath to her all the land that I have held in my possession for the last twenty four years, with the exception of the two gardens on the South Side of aforesaid place, and known as Lewis'es ground. They are to be sold by her for my benefit for Prayers for my soul.
  • Secondly I give her sole possession of all my fishing gear three Cod nets my part of three fishing boats, and my share of fishing trawl with all the rest of my share of fishing gear, with one chain mooring,
  • thirdly I give her sole possession of one half of the big store on beach, occupied by John Murphy and also my share of the small store and one half of the flake opposite the big store over the pond. The flake on the North Side of the brook. I also give in her possession to be sold for my benefit.
  • Fourthly I give her sole possession of my dwelling house and outhouses and all contained thereon, whatsoever and wheresoever and of what nature and quality soever. And I hereby appoint her the sole proprietor and Executrix of this my will.

In witness whereof I have hereunto set my hand this tenth day of April one thousand nine hundred and nine JOHN WALSH X his mark
Signed by the said John Walsh of Broad Cove Bonavista Bay Newfoundland in the presence of us, present at the same time, who in his presence, and in the presence of each other attest and subscribe our names as witnesses thereto.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
