Will of James Walsh from Newfoundland will books volume 5 pages 162-164 probate year 1887

Last will and Testament of
James Walsh of Harbor Grace
Planter.

I James Walsh of River Head Harbor Grace Planter do make this my last will and Testament for and on behalf of my family. - I hereby bequeath to my son Patrick all my property on the north side of River Head bounded on the south by the waters of the Harbor; on the west by the property of Edward Hynes, on the east by the property of Samuel Gillispie on the north by the property of John Sullivan. - To have and to hold the aforesaid property for ever. If in case he should not marry (or if he does) and have no issue the said lands and property is to go back at his demise to his brothers and sisters (if alive), if not to the nearest of kin, and I further declare that my son Patrick can never mortgage sell or transfer the aforesaid property or be taken for debt, but is to go back to the nearest of kin, or his heirs if he have any.
The wharf opposite the said property each of my sons Patrick, Richard and Thomas are to keep in a thorough state of repair and to bear proportionately their share of said expenses.
I bequeath my property situate at the bottom of River head now in possession of my son Richard to him bounded on the South by the Fishermans Road, on the East by Church land, on the North by the Cooper Corner road on the West by Thomas Shanahan. To have and to hold for his natural life time only that is in case he die without issue. - If he have any children the property becomes theirs as his heirs and successors if on the contrary the aforesaid property goes back to his brothers and sisters or nearest of kin, at his demise. He can make any improvement on said land whilst living My horse is to have for his support, any part of said land as usual. - This property is never to be mortgaged sold or transferred for debt to any person or persons whilst there is a member of my family living. - There is also another piece of land situated on the Fishermans Road part now occupied by my son Richard he is to have and to hold on the same conditions as aforesaid in the other property. For his natural lifetime if he die without issue. - Then to revert to his brothers and sisters (or nearest of kin) He is also to make what improvements he thinks fit on the said part of property. - This property is bounded on the South by Fishermans Road, on the East by Patrick Coady, on the North by the same, on the West by Nicholas Shanahan.
The remainder of said land is to become the property of my son Thomas after his fathers and mothers death my daughters Bridget and Margret is to get their support out of said property if they require it. -
The house and land I now occupy myself, bounded on the South by the Cooper Corner Road, on the East by Healy's property, on the North (by the blind path) on the West by Walter Sinnot my wife Bridget is to have and to hold all said property for her natural life, and to have full and entire control over said land and premises. At her death said property is to become my son Thomas's his heirs and successors provided he die with issue, if not to revert back to his brothers and sisters or nearest of kin. His sisters Bridget and Margaret is to have their support out of said property for their natural life, if they require it. - This property never can be sold mortgaged conveyed transferred or taken for debt, but is to remain as the Walsh Estate whilst there is a member of my family living. In the meantime if Thomas should die this property shall become the property of my son Patrick and of my daughter Bridget and Margaret conjoined.
The inside farm at River Head bounded on the North by Peter Dwyer East by Patrick Coady South by Lawrence Ryan; West by Thomas Russel all this farm is to become the property of my son Thomas at the death of his father & mother. His sisters to have their support out of it if required as aforesaid. - I further bequeath to my son Patrick the sum of Forty pounds Currency, which is now deposited in the savings Bank at Saint John's - I bequeath the sum of Forty pounds Cy to my son Richard now deposited in the Savings Bank St. John's. And also to my son Thomas the sum of Seventy Cy now deposited in Savings Bank Saint John's - My daughters Bridget and Margaret each to have the sum of Fifty pounds Cy making one hundred, Margaret's money is deposited in the Union Bank; Bridget's the Savings Bank Saint John's. -My wife Bridget is to have the sum of Eighty pounds Cy now deposited in Savings Bank Harbor Grace. - Whatever goods monies or chattels my wife may be possessed of at her death she may will the same to whom she thinks the best entitled to it by making a will or in any way she thinks the best course to adopt.
Signed sealed and executed in the presence of the two subscribing witnesses I hereby appoint Mr. William Dunn my executor to carry out the full condition of this my last will and Testament. After being first read over and explained to the said signataries. Dated in the year of our Lord one thousand eight hundred and eighty six. January twenty third. Signed sealed and delivered in the presence of the two subscribing witnesses being now in the full possession of my faculties, and power of speech and thoroughly satisfied of its correctness. - James his x mark Walsh. Executors signature and other witness. William Dunn. Witness William Glyndon.
