In re DECEASED.
JAMES WADDLETON (of Samuel)
This is the last will and testament of me James Waddleton (of Samuel) of the
town of Trepassey in the Dominion of Newfoundland.
(Item 1)
Firstly. I bequeath to my son Thomas Waddleton one half of all my property,
exclusive of my house and its contents, consisting of four meadows whose situation
is designated on surveys made by D. J. Pennell of Trepassey Deputy Surveyor
of crown lands and which papers will be found enclosed with this my last testament.
(Item ii)
Secondly. The other half of my estate as mentioned in item one of this will
I leave to my son James Michael Waddleton.
I will that my sons Thomas and James Michael shall make an equal and fair division
of this property between them and that they must employ a surveyor to properly
make this division so that there may be no dispute and I ALSO desire that the
division properly made by a surveyor be agreeable to both parties of the will.
Item III.
I will that my beach property consisting of 60 yards be equally divided between
my sons Thomas and James Michael (i.e. 30 yards for each of them) (Note that
I received no money from the Railway Commission for the S. W. Beach).
Item 4. I bequeath my house and its contents and the Kitchen garden attached
thereunto, exclusive of the stable to my son James Michael Waddleton.
Item 5. I bequeath a half share in my stable to my son Thomas, the other half
share to my son James Michael.
Item 6. I will that my sons Thomas and Michael divide equally my tools.
I
appoint John Devereaux (of Geo) as my sole executor.
Dated at Trepassey
in the dominion of Newfoundland this fourth day of October in the year of our
Lord one thousand nine hundred and twenty eight.

presence and in the presence of each other have set our names.
