In re
      RICHARD TUCKER       deceased.

      This is the last will and testament of me Richard Tucker of Saint Philips St. John’s West Newfoundland Farmer.    I give devise and bequeath unto my son Algernon Tucker all that portion of my property which is situate in the center of the Cove of Saint Philips aforesaid on both sides of the main road containing about three roods more or less and is bounded as follows that is to say on the North by land of my late brother Jacob Tucker on the South by a small stream or brook on the East by a reserved roadway and on the West by land of my late brother Jacob Tucker this said portion to be held and enjoyed absolutely and unconditionally by the said Algernon Tucker my son and by his heirs and assigns.

      The remaining portion of my property upon which I now reside consisting of about five acres of cultivated farm lands and about fifteen acres of uncultivated wood lands together with about twenty acres of uncultivated wood lands situated immediately to the south of the first lot of twenty acres from which it is separated by a reserved roadway I give devise and bequeath unto my two youngest sons Richard Tucker and Abner Tucker these portions of my property being divided between these my two sons aforesaid in just and equal portions that is to say half of the cultivated lands aforesaid together with half of the uncultivated lands to be the property of my son Richard Tucker and the remaining half to be the property of my son Abner Tucker

My dwelling house wherein I now reside together with my barn and other outhouses situate on this property is to be the joint possession of these my two sons aforesaid until such time as my son Richard is enabled with the aid and assistance of his brother Abner to build a dwelling house and outhouses for himself after which this my dwelling house and outhouses should become the sole and absolute property of this my youngest son Abner To this my son Abner I also give devise and bequeath all other possessions or properties not herein specified that I may die possessed of or be entitled to for his sole and separate use and benefit

It is also my will that should my wife Elizabeth survive after my decease and remain unmarried then she is to be decently supported and maintained during the full term of her natural life by these my two sons Richard and Abner provided that she be agreeable and contented to live with them Also that my daughter Bertha Ann so long as she do remain unmarried and is willing to give such reasonable assistance as may be required when able to do so shall be supported and maintained in the same manner by these my two sons aforesaid I also desire that my daughter Mrs. W.J. Kent of St. John’s be permitted by these my two sons Abner and Richard to have the use of the two rooms in the north end of my dwelling house during a short period in the summer months or at any time that she may reasonably require the use of them.    I hereby revoke all other and former wills by me made and declare this to be my last will and testament and I appoint Wm. J. Kent Esq of Saint John’s to be executor of this my will    August 26^th A.D. 1911.    Richard Tucker.     Signed published and declared by the said Richard Tucker as and for his last will and testament in the presence of us the subscribers who in the presence of the said testator and of each other have hereunto subscribed our names as witness this twenty sixth day of August Anno Domini one thousand nine hundred and eleven    Kenneth Squires     Solomon Tucker
