Will of Jacob Toms from Newfoundland will books volume 5 page 442 probate year 1889 The last will and Testament This is the last will and Testament of Jacob Toms Planter, Shoe Cove Notre Dame Bay Newfoundland. I hereby give devise and bequeath to my wife Elizabeth Toms my house and household furniture and the interest on all moneys which I have lodged in the Bank. During her lifetime the principal is not to be drawn upon; and at her death the said moneys in Bank are to be divided equally between my son William Toms and my daughter Mary Ann Toms or their successors. At the death of the said Elizabeth Toms my house and household furniture becomes the property of the said William Toms his heirs and successors; but the said Mary Ann Toms is to have an equal right to the said house etc with her brother William while she remains single should she marry she will lose all claim thereto. All my lands waterside premises, storehouses, boats, nets etc I give and devise to my son the aforesaid William Toms his heirs and successors for their own use and benefit absolutely. And I hereby appoint the said William Toms executor of this my will. In witness whereof I have hereunto set my hand this seventh day of August one thousand eight hundred and eighty eight. Jacob his x mark Toms Signed by the said Jacob in the presence of us present at the same time, who, in his presence and in the presence of each other attest and subscribe our names as witnesses Arthur Pitman, Clerk in Holy Orders, Twillingate, witness Chief Clerk & Registrar
