Will of Thomas Tobin from Newfoundland will books volume 5 pages 253-255 probate year 1888

Last will and Testament of
Thomas Tobin late of St. John's
boatman, H. M. Customs deceased.

In the name of God Amen.

I Thomas Tobin of St. John's an officer of His majesty's Customs at the said port do make and publish this as and for my last will and testament.
First. I direct that all my just debts funeral and testamentary expenses shall be paid.
Secondly. I give devise and bequeath to my wife Mary all my right and interest in and to the dwelling and premises in which I now live and also all the household furniture good chattels and effects therein.
Thirdly. I give devise and bequeath to my said wife all the moneys deposits in the Newfoundland Savings Bank in her name.
Fourth. To the widow Jane Power relict of the late Maurice Power I give and devise the sum of eighty-six pounds currency for her own sole use and benefit.
Fifth. To Ellen Casey widow now residing in Witless Bay I give and devise the sum of eighty-six pounds currency.
Sixth. To the wife of my nephew Thomas Tobin now residing in St. John's I give and devise the sum of eighty-six pounds for her sole and separate use and to be paid and payable to her in such sums and at such times as my executor hereinafter named shall think proper.
Seventh. To my brother Richard Tobin now residing in St. John's I give and devise the sum of eighty-six pounds to be paid and payable to him in such sums and at such times as my executors hereinafter named shall think proper.
Eighth. To Bridget Keeffe wife of Thomas Keeffe of St. John's Cooper I give devise and bequeath the sum of eighty-six pounds to be by her taken as separate estate free and clear of the debts liabilities and control of her husband.
Ninth. To my nephew Mathew Costello now of St. John's fisherman I give devise and bequeath the sum of eighty-six pounds currency.
Tenth. To my executor hereinafter named I give devise and bequeath the sum of fifty pounds currency in trust to pay the same for the use and benefit of the Roman Catholic Orphanage at Belvidere near St. John's.
Eleventh. to my said executor I give and bequeath the sum of fifty pounds currency in trust to pay the same for the use of the Church of St. Patrick at Riverhead in St. John's.
Twelfth. to my said executor I give and bequeath the sum of ten pounds for a High Mass for the repose of my soul and the further sum of twenty pounds to be expended for masses for the repose of my soul.
Thirteenth. I give devise and bequeath the sum of Thirty pounds to the Reverend Patrick Delaney of St. John's for his own sole and absolute benefit. I direct that my executor shall cause a tombstone to be erected over my grave at Belvidere and that if necessary each of the said legacies shall abate proportionately towards the cost of the said stone.
Lastly I do hereby nominate and appoint the Reverend Patrick Delaney of St. John's executor of this my will and do hereby revoke and annul any previous other wills by me made. Thomas Tobin.
Signed by the said Thomas Tobin in our presence as and for his last will and Testament who in his presence and at his request and in presence of each other have hereto set our hands as witnesses at St. John's aforesaid this first day of April Anno Domini 1880. Patrick J. Delaney. Robert J. Kent.
