Last Will of Joseph Tilley late of
Kelligrews, Planter, deceased.
In the name of God. Amen. I Joseph
Tilley of
Kelligrews South Shore, Conception Bay Newfoundland being very sick and weak
in body but of perfect mind and memory do make and ordain this my last will
and Testament.
First. I give and bequeath to my beloved wife Sarah
Annie all that I possess for her sole use and benefit and the benefit of my
two children Elizabeth and Violet viz dwelling house estate goods and chattles,
cultivated and uncultivated land, dray catamaran garden implements and calf.
If my wife should become distressed and in poor circumstances, I give her full
power to dispose of all the above property so as to keep herself and the children
from want. I give and bequeath to my daughter Elizabeth twenty five dollars
($25.00) of the amount of the money that my wife would receive for the said
property if she has occasion to sell it. My daughter Elizabeth can seek a situation
for herself after my death so as to earn her own living. If my wife should
not dispose of the property but live upon it and my daughter Elizabeth become
sick and not provided for that is married, my wife is to let her come home
and stay till she would get better and I hope my wife will be kind to her.
If my wife should not sell the property and married or died my daughter Violet is to take possession of the above named property in either case.
The
land that my dwelling house and stable etc are situated on was given to me
by my father Joseph Tilley on the eighth day of September A.D. 1883 and is
bounded as follows, on the north by my father's land and measuring 122 feet
south by main road leading to Holyrood and measuring 63 feet East by Farrells road (breakwater road) and measuring 47 feet and west by land given to my brother
William James Tilley by my father and measuring 384 feet my land in the country
is bounded on the north by Edward Tilley of Wm land south by crown land, east
by Albert Seward land and on the west by LeDrew's land and containing eleven
acres one road & 6 perches (11 acres road 6 perches) and I do hereby utterly
disallow & revoke and disannul all and every other former testaments, wills
and bequests by me in anywise before named willed and bequeathed, ratifying
and confirming this and no other to be my last will and Testament.
In
witness whereof I have hereunto set my hand & seal this 16 day of September
in the year of our Lord one thousand nine hundred and one. Joseph Tilley (L.S.)
Signed sealed published pronounced and declared by the said Joseph
Tilley as
his last will and Testament (having been first read over) in the presence of
us who in his presence and in the presence of each other have hereunto subscribed
our names as witnesses. Francis F. Furneaux Commissioner of Affidavits. Mary
Bains.
I certify that the foregoing is a correct
copy of the last will of Joseph Tilley
