Will of Ann Thomas In re This is the last will and testament of me Ann Thomas of Number 31 Derby Lane Stoneycroft near Liverpool Widow I give to my son Temple Piers Thomas all my household furniture plate linen china books pictures and other household effects I devise to the said Temple Piers Thomas as long as he lives and remains single the moiety I possess in the ground rent of the Commercial Bank in St. John’s Newfoundland say nineteen pounds ten shillings sterling also the moiety of the ground rent of a house occupied by Mr. Dearing in Water Street St. John’s Newfoundland say twenty five pounds currency due every year on the 1st of April 1st of May also on the 1st day of October and 1st of November Also all the shares I hold in the Midland Railway On the decease or marriage of said Temple Piers Thomas whichever shall first happen then I devise the said ground rents and Railway shares as follows in case of marriage all to be divided into three equal parts for my three sons Henry Charles Binney Thomas Temple Piers Thomas and Augustus William Thomas but in case of death into two equal parts for Henry Charles Binney Thomas and Augustus William Thomas in equal parts as tenants in common absolutely I appoint the said Henry Charles Binney Thomas and Augustus William Thomas executors of this my will In witness whereof I have hereunto set my hand this fifth day of July one thousand eight hundred and seventy three- Ann Thomas- Signed by the said testatrix Ann Thomas as and for her last will and testament in the presence of us who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses- George Lord. Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor. We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be. |
