In re
John Robert Thistle deceased.
This is the last will and Testament of me John Robert Thistle of Saint
John's Shopkeeper I hereby revoke all other wills by me at any time heretofore
made I direct that my debts and funeral and testamentary expenses be paid
I give and bequeath to my wife Margaret Thistle the sum of one hundred
dollars to be paid to her immediately after my decease. All the rest residue
and remainder of all my estate lands houses property debts credits moneys
goods chattels and effects whatsoever and wheresoever situate I give devise
and bequeath to my Executors hereinafter named upon trust to sell realize
and convert the same into money and out of the proceeds thereof to pay
all debts charges and expenses whatsoever and in the next place pay the
following legacies, namely: -To my daughter Annie (wife of N.
Snow) Ten
dollars To my son Alfred Thistle Ten dollars To my daughter Jessie (wife
of Tilley) Ten dollars to my daughter Isabella (wife of Wm.
?Bright) Twenty
dollars To my son William Thistle Thirty dollars To my sister Mrs.
George Kirkland Ten dollars To my sister Mrs Jonathan
Tricott Ten dollars And
to hold the balance thereof in trust as to one half or moiety thereof for
my said wife Margaret for and during her life and after her death in trust
for my two daughters now living with me namely Gertrude and Lillian share
and share alike and in case of the death of either of my said daughters
Gertrude and Lilian before the death of my wife then the share of the one
so dying shall go to the other with power to my Executors in the meantime
to invest the same upon mortgage of landed property or such other security
as they shall deem prudent And as to the other half or moiety thereof in
trust for my said daughters Gertrude and Lilian share and share alike payable
when they shall respectively attain the age of twenty one years with power
to my Executors in the meantime to pay to and for them respectively out
of Capital such sum as they (my executors) shall think sufficient for the
education maintenance and support respectively of my said two daughters
and with power also to my Executors to invest the Capital upon mortgage
of landed property or such other security as they shall deem prudent And
in case of the death of either of my said daughters before reaching the
age of twenty one years her share shall go to the other-
I appoint Archibald Lindsay of St. John's accountant and George
Neal of
same place commission merchant to be the Executors and trustees of this
my will- Dated at St. John's aforesaid this twenty-first day of October
Anno Domini Nineteen Hundred and Seven John R. Thistle Signed
Published and Declared by the said testator John Robert Thistle in
the presence of us who in his presence at his request and in the presence
of each other (all being present at the same time) have hereto signed our
names as witnesses (the word "son" having been first
inserted on the first page instead of the word "daughter") Fredk.
