Last Will and Testament of
Thomas Talbot of St. John's
Gentleman deceased.
In the name of God Amen. I Thomas
Talbot of St. John's in the Island of Newfoundland being of sound mind and
memory, tho' suffering from ill health do make & ordain this my last will
and Testament And for the purpose of carrying out my intentions in this respect
I hereby appoint as my Executors & Trustees the following namely the Most
Revd R.C. Bishop of St. John's, the Very Rev'd John Scott, Administrator of
the diocese of St. John's, and the Very Rev. Dean Ryan Parish Priest of St.
Patricks Riverhead of St. John's, and their successors for ever. All my property
including cash, Government debentures, water stock included) shares in the
Commercial Bank of St. John's, deposits in the Commercial Bank, Union Bank
and Savings Bank of St. John's shall be invested in Government & other
good securities from time to time as the necessity may arise - a considerable
amount is already invested in Government debentures including water stock.
All property of every kind of which I may be possessed at my death shall be
realized & invested as above.
My debts whatever they may be at
my death shall be first paid, and any debts that may be due me at that time
shall be collected & invested in like manner as my other property. But
before my property shall be finally invested as above, the following sums shall
be first set apart for the purposes herein mentioned, namely a reasonable sum
to defray the expenses of my burial in a decent but not ostentatious manner:
the sum of fifty pounds cy for Masses for my soul to be offered as soon as
possible after my death, and to be distributed for this purpose by my above
mentioned executors. The annual interest or income derived
from my property invested as above shall be appropriated as follows: (1)
The sum of $100 (twenty five pounds cy) shall be annually set apart fo Masses
for my soul and for the souls of my family now dead, for ever. (2)
The sum of $200 (fifty pounds cy) shall be paid annually to Bride Vinicombe eldest daughter of William
Vinicombe of Cochrane Street St. John's in gratitude
for her long services to me while occupying apartments in her fathers house.
This amount is to be paid to her half yearly or quarterly as may better suit
my Trustees but she shall not sell it or dispose of it in any way during her
life: but at her death she may dispose of it in any way she pleases for the
benefit of any member or members of her family.
(3) The sum of $200
(fifty pounds cy) shall be paid annually to the Sisters of Mercy of the Belvideres
Girl's orphanage for the benefit & support of said orphanage. (4)
The sum of $200 (fifty pounds cy) shall be paid annually for the benefit & support
of a boy's orphanage should such an institution be established under the direction & control
of the Christian Brothers. But in the event of no such institution being established
this amount shall go to the maintenance, support of one or more poor students
in St. Bonaventures College who may have a vocation for the ecclesiastical
state, to be expended under the direction & control of the R.C. Bishop
of this diocese - this until a boys orphanage shall be established under the
control of the Christian Brothers when the amount shall be transferred to them. (5)
The sum of $200 (fifty pounds cy) shall be paid annually to the Sisters of
Mercy of the Military Road Convent to be distributed by them from time to time
among the sick poor whom they may visit, and whose necessities they may be
able to ascertain from personal observation. (6) The sum of $200
(fifty pounds cy) shall be paid annually to the Presentation Convent, Cathedral
Square for the benefit of that Institution under the direction of course of
my Trustees. (7) The sum of $200 (fifty pounds cy) shall be paid
annually to the Presentation Convent, St. Patricks, Riverhead for the benefit
of that Institution, under the direction of course of my Trustees (8)
The sum of $200 (fifty pounds cy) shall be paid annually to the St. Vincent
de Paul Mens Society for the relief of the destitute poor; that is while such
a society exists and is actively engaged in their charitable work under the
approbation & direction of my Trustees. Should it however cease to work
or become objectionable to my Trustees, then this amount shall be expended
for the benefit of the destitute poor under the management of said Trustees. (9)
The sum of $200 (fifty pounds cy) shall be paid annually to the St. Vincent
de Pauls Women's Society for the relief of the destitute poor, that is while
such Society exists and is actively engaged in this charitable work under the
direction & approbation of my Trustees. Should it however cease to work
or become objectionable to my Trustees the amount shall be expended for the
benefit of the destitute poor under the management of said Trustees.

Whatever amount may remain over annually after the above distribution shall
be expended in the building & repairing of Churches & convents in those
portions of the diocese outside St. John's where the R.C. population are comparatively
poor, and in all cases preference shall be given to the poorer missions districts
or parishes. Before the expenditure of any sum, however is made upon churches & convents,
the necessary expenses incurred in carrying out the other provisions of this
my will shall be first defrayed. Should the income divisible from my property
in any one year fall short of the appropriations made under the above nine
beads, that is from the 2nd to the 10th inclusive, equal reductions
shall be made from them all, except that of Bride Vinicombe whose allowance
shall never be disturbed. I earnestly request the prayers of all those poor
people & orphans
who shall be relieved by this distribution of my property.
This my
last will & Testament (all other wills & Testaments heretofore made
by me being hereby annulled) I make & ordain in the most solemn manner,
and in the presence of my heavenly Father, the God of infinite mercy and boundless
love, and affix to it my hand & seal this twenty fourth day of September,
one thousand eight hundred and ninety-four. (Sgd) T. Talbot (LS)
