Will of John Stucless
from Newfoundland will books volume 2 page 5 probate year 1850.

In re
     John Stucless       deceased.

In the name of God Amen. I John Stucless Planter in Twillingate in Green Bay in the Island of Newfoundland being weak in body but of perfect mind and memory thanks be given unto God; calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and testament, that is to say principally and first of all I give and recommend my soul into the hand of Almighty God that gave it, and my body I recommend to the earth to be buried in a decent Christian burial at the discretion of my executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God. And as touching such worldly estate wherewith it has pleased God to bless me in this life I give, demise and dispose of the same in the following manner and form.
First, I give and bequeath to my beloved sons James & Alexander my Room comprising dwelling house and furniture, store and outhouses, stage, flakes, gardens, boat, skiffs, punts, nets, seines, &c. &c. &c to be by them freely possessed and enjoyed. Also I give to Lydia my dearly beloved wife my watch and that she receive from my two sons James and Alexander out of my estate whatever is necessary for her temporal comfort and support during her life time. I do further give and bequeath to my beloved daughters Elizth Cull, Dinah Ware and Charlotte Lovridge, the sum of ten pounds sterling each. Also to my beloved sons John and William the sum of ten pounds sterling each, and the remainder of my money, wherever lodged, to my beloved sons James and Alexander and it is my desire that they remain together in the Room during their life time. I appoint Mr. James Moore and Mr. Robert Roberts Senr to be executors of this my last will and testament; And I do hereby utterly disallow revoke and disannul all and every other former testaments wills legacies bequests and executors by me in any wise before named, willed and bequeathed, testifying and confirming this and no other to be my last will and testament.
In witness whereof I have hereunto set my hand and seal this twenty seventh day of November in the year of our Lord one thousand eight hundred and forty four. John Stucless his X mark (LS)

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
