Last will and Testament of
Susanna Spencer of Cul de Sac
District of Burgeo & LaPoile
widow deceased

      In the name of God Amen I Susanna Spencer of Cul de Sac in the Island of Newfoundland in the District of Burgeo & LaPoile being in good health and of sound and disposing mind and memory calling to mind the frailty and uncertainty of human life and being desirous of settling my worldly affairs and directing how the Estate with which it has pleased God to bless me shall be disposed of after my decease while I have strength and capacity so to do, do make and publish this my last will and Testament hereby revoking and making null and void all other last wills and testaments by me heretofore made and first I commend my immortal being to him who gave it and my body to the earth to be burried with little expense or ostentation by my Executors hereinafter named.
Imprimis. My will is that all my just debts and funeral charges shall by my Executors hereinafter named be paid out of my estate as soon after my decease as shall by them be found convenient.
Item. I give devise and bequeath all monies in the Bank shares, and in my house that I may possess, that the time of my death to my children - viz Stephen Spencer, Matthew Spencer, Charles William Spencer, Mary Ann Bagg John Spencer, Susanna Spencer, James Henry Spencer, Caroline Louise Spencer, Catherine Berthana Spencer Arthur Thomas Spencer, Simon Nathan Spencer, to be equally divided amongst them ie share and share alike.
Item. I furthermore devise and bequeath to my youngest son Simeon Nathan Spencer my dwelling house household furniture and all my waterside premises situated at Cul de Sac in the District of Burgeo & LaPoile Newfoundland consisting of stores, shop flakes, splitting stages, all grounds attached to the same, and dwelling house to the said Simeon Nathan Spencer his heirs and assigns for ever. -
Lastly. I do nominate and appoint the Reverend George Bishop Rural Dean, Hermitage Cove H.B. and my brother Thomas Barter, Trader, Cape La Hune district of Burgeo & LaPoile Newfoundland to be my Executors of this my last will and testament. In testimony whereof I the said Susanna Spencer have subscribed my name and affixed my seal. (Sgd) Susanna her X mark Spencer (LS)

Codicil.

Further I add as a Codicil to my last will and Testament: - That in the event of the death of my son John Spencer his share of my money shall be equally divided amongst his brothers and sisters. Also the stock in trade, schooners, nets, seines, boats, gear and other appliances connected with the trade shall become the property of my three sons James Henry Arthur Thomas and Simeon Nathan to be held and used by them conjointly for their mutual benefit and advantage until Simeon Nathan shall attain to the age of twenty one (21) years, when the fixed property shall be his, and all the moveable property schooner, nets, seines, boats gear and other appliances shall be divided into three equal shares to be held used or disposed of as each one and all three shall determine. In witness whereof I Susanna Spencer do set my name this 20th day of June 1894. (Sgd) Susanna her X mark Spencer. Signed by the Testator Susanna Spencer and acknowledged to be the codicil to her last will and Testament in the presence of us, who at her request and in the presence of her and of each other subscribe our names as witnesses hereunto. (Sgd) Annie Hare (Sgd) George H. Bishop.

      Signed Sealed and declared by the Susanna Spencer as and for her last will and Testament in the presence of us who at her request and in her presence and in the presence of each other have subscribed our names as witnesses hereto.
