Last will and Testament of
Joseph B. Snow of St. John’s
Keeper Municipal Council Stables. deceased
This is the last will and Testament
of me Joseph Snow of St. John’s Keeper of the
Municipal Stables.
First. I direct that all my just debts and funeral
and testamentary expenses be first paid out of my Estate.
Secondly. I
bequeath to my son Samuel Snow my watch and in the event of his predeceasing
me I bequeath the same to my son Joseph B. Snow.
Thirdly.
I bequeath to my brother John Snow all my clothing and
I direct that he shall have the use free of charge of a room in whichever
of my houses the family shall reside for the term of his natural life,
provided he shall occupy the same
Fourthly I bequeath to my wife Julia
Snow the rents and profits of my houses after payment of the ground rent
and insurance for the term of her natural life or which she shall remain
unmarried, to apply the same to the support and maintenance of herself
and of my children and of my brother John. And I also
bequeath to her for the same purposes and subject to the same condition
as to remarriage, the sum of one hundred dollars yearly out of the monies
of which I shall die possessed until the same shall be exhausted. The
said rents profits and monies to be paid her by my Executors and Trustees
hereinafter appointed.
Fifthly. In the event of my said wife’s remarriage all benefit
to her under this my last will shall cease.
Sixthly. In the event of
my said wife’s remarriage or death I direct that the balance of
my Estate then remaining shall be divided as follows amongst such of
my children as shall then be living and the children of any child or
children who shall have predeceased by said wife’s death or remarriage,
leaving lawful issue such children to take their parents share equally
between them viz: - to my son Samuel the house on Fleming Street to my
daughter Emma the western part of the house on McDougall Street and to
my son Joseph B. the Eastern part of the house on McDougall
Street.
Seventhly. In the event of the death of all my said children
without leaving lawful issue before the death or remarriage of my said
wife, she my said wife shall have the use and benefit of the yearly rents
and profits of my estate as before provided for herself.
Eighthly. In the event
of the death of all my children without issue and of the death of my
said wife or her remarriage I direct that the balance of any said estate
shall become the property of my said brother John
Ninthly.
I bequeath to my daughter Emma my piano.
Tenthly. All
the beds furniture goods chattels and effects which shall be in my house
at the time of my death shall be for the use and benefit of my said wife
and children and my brother John whilst my said wife shall live and remain
unmarried, and at her death or remarriage the same shall be equally divided
amongst my children who shall then be living and the children of any
child or children who shall have died before my said wife’s death
or remarriage, such children to take their parents share. And I direct
that at any such division my said brother John shall have a full share.
I appoint John Bussey of St. John’s Picture Framer and James
Roil of St. John’s Sheriff’s Deputy Executors of this my last
will and Trustees for the Estates of my said children. Witness my hand
at St. John’s this Thirty first day of July A.D. one thousand eight
hundred and ninety six (sgd) Joseph B. Snow. Signed published and declared
by the said Testator in presence of us, who in his presence and in the
presence of each other all present at the same time have hereunto subscribed
