In re
Michael F. Smyth deceased.
In the name of God amen this is the last will
and testament of me Michael F. Smyth of St. John’s
in the Island of Newfoundland, Machinist
First it is my will and desire
that my executors hereinafter appointed shall pay all my just debts funeral
and testamentary expenses.
Second
I give devise and bequeath to my dear wife Mary Smyth all and singular
my houses and lands comprised as follows that is to say. The house number
286 Water Street, and ground thereunder and attached one house Monkstown
Road. House store and ground Maxse Street, Ground opposite Ordinance
Yard. Ground on North side of Quidi Vidi Lake, one government debenture
for two hundred and fifty dollars. Land situate at Topsail comprising
fifty acres. Morrisons farm twenty five acres, together with my business
stock in trade, goods, monies, chattels, and effects situate wheresoever
and of whatsoever description or kind I may die possessed of for her
sole use behoof maintenance and support and the maintenance and support
of our daughter Annie M. Smyth during her lifetime.
Thirdly I hereby appoint my said wife Mary Smyth and the Honourable
John Harris Executrix and Executor of this my last will and
testament.
Lastly I hereby revoke and declare void all former or other
wills that may have been made by me. In witness whereof I have hereunto
my hand set and subscribed at St. John’s
aforesaid this fourth day of December Anno Domini one thousand nine hundred
Signed by the said testator as and for his last will and testament in our presence
who in his presence at his request and in the presence of each other have hereunto
subscribed our names as witnesses thereto M. V. Smyth Thomas
