Will of William Smith
from Newfoundland will books volume 12 page 203 probate year 1922

In re WILLIAM SMITH       DECEASED

In the name of God. Amen.
I, William Smith, formerly of Hant's Harbor but now of St. John's, in the Dominion of Newfoundland, being in good health of body and of sound mind and memory, do make and ordain this my last will and testament in the following manner and form, that is to say, first of all I commit my soul into the hands of Almighty God who gave it and my body I commit to the earth to be buried in decent Christian burial. I ordain that all just debts that I may owe at the time of my decease be paid and also that my funeral expenses be paid out of the money that I die possessed of, after which debts and funeral expenses have been paid, I give and bequeath to William Smith, son or Aaron Smith of Hant's Harbor all and singular the residue of my monies and my personal effects, that is to say, the money that I have in the Bank of Nova Scotia or any other Bank or Banks together with any money that may be in my possession at the time of my decease, also two feather beds and bed clothes, in a word, everything that I die possessed of I give and bequeath to the aforesaid William Smith of Aaron.
I hereby appoint Mr. James W. Janes of Hant's Harbor to be the sole executor of this my last Will and Testament, revoking and annulling all other Wills or Testaments by me at any other time made, testyfing and declaring this to be my last Will and Testament.
Signed, Sealed Published and declared, and acknowledged by him to be his last Will and Testament, in the presence of us present at the same time, and subscribed by us in the presence of the Testator and of each other, this 18th day of February in the year of Our Lord, One thousand nine hundred and twenty one. WILLIAM SMITH.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
