Will of Moses Smith
from Newfoundland will books vol 11 pages 218 & 219 probate year 1918

In re Moses Smith       deceased

This is the last will and testament of me, Moses Smith, of Elliot's Cove, Random, Trinity Bay, made this ninth day of December A.D. 1913.

  1. I hereby revoke all former wills and testamentary dispositions by me at anytime made, and declare this to be my last will and testament.
  2. I appoint my son Harrison Smith, to be the sole executor of this my last will.
  3. I give, devise and bequeath the following specific legacies:-
    [a] to my daughter Alfreda Smith a sewing machine, which she now has in her possession.
    [b] to my daughter Lucy the bed and bedding which she now has in her possession.
    [c] to my son Ephraim that piece of land on which he has erected his dwelling house and other premises, which said land is bounded as follows:- beginning on the North-east side of my land and running by the main road two hundred and fifty-four feet. Course on the North East side South 30 degrees east. And on the South west side, South east running inland as far as my grand extends.
    [d] to my son George that piece of land situate on the main road at Elliot's Cove, having a frontage of sixty feet and bounded as follows:- beginning where my son Ephraims ends, and bounded on the North East side by fence running South East. And on the South West side by fence running South East. And running inland as far as the grand extends.
    [e] to my son Harrison, my sawmill and all of the lands used as a site thereof or in any way connected therewith.
  4. All my uncleared and uncultivated land I give, devise and bequeath to my three sons, Harrison, George, and Ephraim, to be equally divided between them.
  5. All the rest, residue and remainder of my lands, houses, premises, monies, goods, chattels and effects of whatsoever nature and kind and wheresoever situate, of which I may die possessed, I give, devise and bequeath to my son Harrison, in trust for the support and maintenance of my wife during her natural life, should she survive me, and on her death to my said son Harrison absolutely.

In testimony whereof I have hereunto subscribed my hand, at Elliot's Cove aforesaid, the day and year first above written. Moses Smith - signed by the said Testator as and for his last will and testament, in presence of us, who, in his presence, at his request and in the presence of each other, have hereunto our names subscribed as witnesses. Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
