Will of Elizabeth Smith
from Newfoundland will books volume 7 pages 434 & 435 probate year 1905

In re the Estate of Elizabeth Smith       deceased

I Elizabeth Smith wife of the late Alfred Smith deceased of Cupids Conception Bay in the Island of Newfoundland, being of sound mind and memory, do make publish and declare this my last will and Testament in manner following that is to say,

  • Firstly,    I give and bequeath to my son Azariah Smith one feather bed and one bolster.
  • Secondly,    I give and devise to my son Benjamin Smith three feather beds including my best bed and bedding.
  • Thirdly,    I further give and devise to my said son Benjamin Smith all my share of the dwelling house, stable, store, cellar, and gardens the one at the back and the other in front of the said dwelling house and also the garden near Cupids Pond annexed to William Smiths garden.
  • Fourthly,    I further desire that my share of that piece or parcel of land situate at Cupids aforesaid and bounded west by Henry Wells land east by William Spracklins land and all the money of which I shall be possessed at my death and all the rest residue and remainder of my estate to be equally divided between my two sons Azariah Smith and Benjamin Smith aforesaid to have and to hold the same for ever.
  • Lastly,    I hereby nominate and appoint my said sons Azariah Smith and Benjamin Smith to be executors of this my last will and Testament; hereby revoking all former wills by me made.

In witness whereof I have hereunto set my hand and seal this sixth day of April in the year of our Lord one thousand eight hundred and eighty-nine    Elizabeth her X mark Smith (LS)
signed and sealed by the said Elizabeth Smith the testatrix in our presence and in the presence of each other at the same time subscribe our names as witnesses.   George Smith, Cupids (Planter)    Wm. Hy. Pearce, Cupids, Teacher.

I certify the foregoing to be a correct copy of the last will and testament of Elizabeth Smith

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
