Will of Azariah Smith
from Newfoundland will books volume 13 pages 352-353 probate year 1926

In re
      AZARIAH SMITH.     DECEASED.

I, Azariah Smith, of Cupids, Conception Bay, Newfoundland, declare this to be my last Will and Testament.

I hereby appoint my son Robert John Smith, sole executor of this my last Will and Testament.

I give and devise to my daughter Ida Louise Wright, wife of Andrew E. Wright of St. John’s, deceased, that piece or parcel of land situated in Cupids, bounded on the North by the waters of the Harbour; South by Serrick’s and Dwyer’s land; East by Benjamin Smith’s land and West by the land of Henry Wells.

I give and devise to my son Robert John Smith and my daughter Ethel Smith that piece or parcel of land situated in Cupids, bounded on the North by the waters of the Harbour; south by Cupids Pond and Sheppard’s land; East by the Methodist Church and Cemetery; West by Taylors land; to be equally divided between them.

I give and devise to my son Robert John Smith the Eastern half of the land upon which we now live, together with the house in which he now lives, barns and all other buildings and appurtenances thereon.

I also give and devise to my son Robert John Smith all the water side property and premises, situated to the North of the Main Road, consisting of Wharves, Stores, Shop, together with all Stock and Merchandise contained therein.

All the rest and residue of my estate of every nature and kind whatsoever, I leave to my beloved wife, Annie Smith, during her natural life, and at her death all the property hereby given and devised to her, as aforesaid or so much of it as may then remain I give and devise to my daughter Ethel Smith, but on the death of my said wife Annie Smith and my said daughter Ethel Smith, this property or so much of it as may remain shall become the property of my said son Robert John Smith.

I direct that my wife, Annie Smith and my daughter, Ethel Smith shall be supported out of the business and the Premium on the Insurance Policy of my daughter Ethel shall also be paid.

I further direct that my daughter Ida Louise Wright shall have a home with my daughter Ethel should she at any time need it or at any time she wishes to come.

In witness whereof I hereunto set my hand this 12th day of May in the year of our Lord One thousand nine hundred and twenty.

Signed by the said Azariah Smith, the testator, in our presence, who in is presence and in the presence of each other at the same time subscribe our names as witnesses.
