Will of Edward Sinnott

In re
      EDWARD SINNOTT.     DECEASED.

      The last Will and Testament of Edward Sinnott. Considering the uncertainty of this mortal life and being of sound mind and memory (Blessed be Almighty God for same) do make and publish this my last Will and testament in manner and in form following (that is to say) I give and bequeath to my beloved wife Ellen during her lifetime all the property real or personal or mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my decease for her sole use and benefit.

Item. I give devise and bequeath to my son Charles the reversion of my dwelling House and land and its appurtenances situated and bounded as follows, North by the Public Road, East by Grants Lane, South by land owned by Andrew Grant and the Nuns of the Convent, West by land & buildings now occupied by Wm Greens Widdow together with the Store known as Royal Stores now rented and occupied by Job Bros & C. Also all the furniture and everything else contained in my dwelling house from and after the decease of my beloved wife Ellen and all the profits, income and advantage that may result therefrom from and after the decease of my said wife, to have and to hold the same to the said Charles his heirs and assigns to his and their use and behoof forever, Provided that should my son Charles die without leaving any child or children, then I direct that all the property herein devised by me to him shall revert to my four daughters namely, Clara Veitch, Isabella O’Reilly, Eliza Hagen and Kate Summers to be equally divided between them.

Item. I give devise and bequeath to my daughter Kate Summers the reversion of the land with the building or buildings thereon and now occupied by Mrs. John Flynn and all profits, income and advantage that may result therefrom, from and after the decease of my beloved wife Ellen to have and to hold the same to her the said Kate Summers her heirs and assigns from and after the decease of my said wife to her and their use and behoof forever. For particulars and boundaries of this land now bequeathed to my daughter Kate, see Deed of lease to Mrs. John Flynn, Signed by Edward Sinnott and witnesses by James Bindon dated 20th day of August 1906.

Item. I give and bequeath to my daughter Eliza Hagen the reversion of the land between the house now occupied by Mary Baldwin and that occupied by & leased to Mrs John Flynn bounded as follows, East by the Main Street, South by the land now leased to and occupied by Mrs John Flynn, North by house now occupied by Mary Baldwin, West by land owned by Martin Barron and all profits, income and advantage that may result therefrom from and after the decease of my beloved wife Ellen to have and to hold the same to her the said Eliza Hagen her heirs and assigns from and after the decease of my said wife to her and their use and behoof for ever.

Item. I give devise and bequeath to my daughter Clara Veitch the reversion of dwelling house and land now in the occupancy of Mary Baldwin and all profits, income and advantage that may result therefrom from and after the decease of my beloved wife Ellen, to have and to hold the same to her the said Clara Veitch her heirs and assigns from and after the death of my said wife, to her and their use and behoof for ever.

Item. I give devise and bequeath to my son Michael the reversion of the land with all the buildings thereon now occupied by Austin Collins and James Murphy & Sons respectively, bounded on the West by the Main Street North by Church and Burkes land, East by Public Street known as Bettys Lane and Burkes land South by Cross Road from Main Road to Bettys Land, together with all the land situate in the South East Arm and known as the Narrows and all the profits, income and advantage that may result therefrom, from and after the decease of my beloved wife Ellen, to have and to hold the same to him the said Michael his heirs and assigns from and after the decease of said wife to his and their use and behoof for ever, provided the land and property herein devised shall not be sold or give away outside the family.

Lastly. I do nominate and appoint my beloved wife Ellen to be the executrix of this my last Will and testament.

In testimony whereof I the said Edward Sinnott have to this my last Will and testament subscribed my name and affixed my seal this 7 day of September in the year of our Lord One thousand nine hundred and ten.

The above instrument was now here subscribed by Edward Sinnott the testator in presence of each of us and was at the same time declared by him to be his last Will and testament and we at his request sign our names hereto as attesting witnesses.

Codicil

Whereas I Ed Sinnott of Placentia have made my last Will and testament in writing bearing date September 7th 1910 and have thereby willed to my son Michael all that piece of land situated in the S.E. Arm and known as the Narrows, now I do by this writing which I hereby declare to be a Codicil to my said Will to be taken as part thereof. And whereas in and by my last Will and testament I have given and bequeathed to my son Michael all the piece or parcel of land above stated. I do hereby order and direct that my will is that only one half of said land be given to him, and that the other half of said land I bequeath to my daughter Isabella O’Reilly And lastly it is my desire that this my present Codicil be annexed to and made part of my last will and testament to all interests and purposes, date of which is Sept 7th 1910 and I hereby confirm same to be my last will and testament.

In witness whereof I hereunto set my hand & Seal this 24th day of October 1910

The above instrument was at the date hereof declared to us by the testator Ed Sinnott to be a Codicil to be annexed to his last will and testament and in presence of each of us subscribed the same and we at his request sign our names as attesting witnesses.
