Will of Henry Simms from Newfoundland will books volume 5 pages 115-116 probate year 1887

The last Will and Testament of Henry Simms.
of Fogo Planter.

I Henry Simms Planter of Fogo Newfoundland being of sound mind do hereby declare this as and for my last will and Testament revoking all former wills. I give and bequeath
I. To my daughters Phoebe, Mary, Emma and Elizabeth I give and bequeath the sum of five pounds currency each
II. To my son Henry's crippled daughter Lucy I give and bequeath the sum of five pounds currency, the said sum to be paid into the Savings Bank and to be handed over to her, with interest, upon attaining the age of twenty one years.
III. To the Church of England Missionary and Church Wardens of Fogo, I give and bequeath the sum of five pounds currency to be expended upon such improvements to the Church as in their united opinions shall be desirable.
IV. To my sons Henry, Samuel, James & George Martin I give and bequeath the sum of forty pounds currency each.
V. To my sons John and William I give and bequeath the sum of twenty five pounds currency each.
VI. To my son James I give and bequeath my dwelling house, with the furniture therein contained, and also my own store & workshop, together with the tools therein contained; only reserving from the aforesaid house furniture a bed for my son George Martin The above bequest to my son James to be conditional upon his providing a home and maintenance for my daughter Elizabeth (Mrs. Waterman) & reserving to her sole use the parlour so long as she requires the same; or otherwise provides for herself by marriage
VII. To my sons Henry, Samuel & James, I give and bequeath in equal shares, my landed property; with all stores fishing flakes, wharves, boats, traps, stages, workshops, with all gear whatsoever, used in the fishery, only reserving the dwelling house & furniture and the store and workshop with tools already provided for in bequests VI. To my son James: But provided any of my three sons as aforesaid viz Henry Samuel and James leave the fishing room then the property provided for in the clause VII to remain in the hands of & the property of the two or one brothers remaining on the fishing room. The land under cultivation is to be used for the joint benefit of my aforesaid sons Henry Samuel and James except in case of removal provided for in clause VII where it is to be and for the benefit of the two or one brothers remaining on the Room.
IX To my son James I give and bequeath any money or monies remaining in the Bank or at Mssrs Watermain's & Co. or in any other place after the aforesaid bequests shall have been paid by the executor to this my last will & testament and after deducting thence from funeral & testamentary expenses & the cost of a headstone to be erected to my memory

X To my six sons James, John, Henry, George Martin, Samuel and William I give & bequeath my clothing the aforesaid John to have my outside clothing namely coats waistcoats & trousers for his share of this bequest the others to arrange the division of the remainder themselves.

I appoint John Smith of Fogo (North side) as my executor to this my last will and Testament. Witness my hand this twenty seventh day of May in the year One thousand eight hundred and eighty five. Henry Simms.
Signed by the Testator in our presence we being at the same time in his presence & in the presence of each other on this twenty seventh day of May in the year one thousand eight hundred and eighty five. John W. Hodge. John Smith.
