      RICHARD RYAN deceased.

      This is the last will and testament of me, Richard Ryan, at present of St. John’s, in the Island of Newfoundland, Gentleman, made this twenty-fifth day of July, Anno Domini one thousand nine hundred and eight.    1. I appoint Sir Edward P. Morris, of St. John’s, King’s Council, executor of this my last will and testament hereby revoking all other and former wills that may have been made by me.     2. I give, devise and bequeath to my wife, Ellan Ryan, and my son, Jeremiah Ryan, the upstairs tenement of the house in which I now reside;     I give devise and bequeath unto my son John Ryan the down-stairs tenement of the house in which I now reside To have and TO HOLD the said tenements unto my said wife and sons for ever.    3. All the moneys of which I shall die possessed I give, devise and bequeath to my executor, with instructions to pay out of the same the sum of forty dollars per year towards the maintenance and support of my wife and children.     In testimony whereof I have hereunto subscribed my hand, at St. John’s aforesaid, the day and year first above written.     Richard his X mark Ryan     Signed by the said testator as and for his last will and testament in the presence of us, who in his presence, at his request and in the presence of each other have hereunto subscribed our names as witnesses (the words “Interest on the” having been first stricken out)    E.P. Codicil to the last will and testament of me, Richard Ryan of St. John’s, in the Island of Newfoundland, gentleman, made the 25^th day of July, 1908     With respect to the bequest contained in my said will of the downstairs tenement of the house in which I now reside, to my son John Ryan, it is hereby provided that he shall at all times pay to my wife one-half the ground rent, and other expenses and outgoings of the said house, and that if at any time he shall fail to pay his said proportion of one half the ground rent, she shall forthwith be entitled to the possession of the said downstairs tenement bequeathed to him, until such time as he may again make such payment.     Richard his X mark Ryan
