Will of Henry Rutherford
from Newfoundland will books volume 2 page 379 probate year 1860

In re
Henry Rutherford deceased.

The last will and testament of Henry Rutherford of Harbour Grace Newfoundland being mindful of the uncertainty of life and also being about to leave the Island on a voyage to sea I hereby bequeath at my death to my daughter Harriet Sophia Rutherford all my property money and interest in the firm of Rutherford Brothers and also what my life may be insured for for her use only and in the event of her death all to be equally divided amongst my brothers sisters and mother and it so to provide one hundred pounds to educate Jessie Stark. Signed this day of May the seventeenth A.D. one thousand eight hundred and fifty eight.    Signed in the presence of Henry McKay and James Foster and in the presence of each other.     Hy. Rutherford (LS), James Foster, Henry Mackay.

Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
