     Richard Roberts      deceased.

The last will and testament of Richard Roberts of Brigus Conception Bay in the Island of Newfoundland-
First I give and bequeath to my son Horatio my house and garden situated in Brigus near the residence of the Revd Dennis Mackin all of which I bought from John Power and do hold a legal Bill of Sale thereto I also give and bequeath to my son Horatio all my other garden situated in Brigus aforesaid which I bought from James Power & of which I also hold a legal bill of sale also my half of a pew in the Episcopal Church of Brigus and the whole of my pew in the Wesleyan Meeting House at Brigus I do give to my son Horatio.     But nevertheless as it appears that my wife Mary is now with child I do desire that my property above mentioned shall be equally divided share & share alike between my son Horatio and my child of which my wife Mary is now pregnant the division to take place when the unborn child now just referred to shall be twenty one years of age and until that time arrives my wife Mary is to have the sole management of my above mentioned property for the benefit and use maintenance and support of herself and my children.
Secondly all the rest of my property consisting principally of a Skiff at the Labrador Grindstone at my mothers my share of cod seine grapnel and cod bags now now in Mr. William Rabbitts store and my share of fishing tack at Labrador, Two grapnels two roads and two sails I do give and bequeath to my wife Mary towards the maintenance of herself and my child or children my wearing apparel I also give to my wife Mary
Thirdly My Gun I give to my son Horatio.

Signed sealed published and declared as & for the last will and testament of the said Richard Roberts in presence of us who in his presence and in the presence of each other have hereunto set our hands as witnesses thereto the said will being first read over to the said testator in our presence before he signed it on this 28th day of March 1846,

Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
