Will of Francis Roberts Last Will and Testament of This is the last will and testament of Francis Roberts of Wild Cove Twillingate Planter first I give devise and bequeath to my wife Elizabeth Roberts my dwelling house furniture and effects for her sole use and benefit, for the term of her natural life, and at her decease the dwelling house shall be my son Benjamins and the household furniture to be equally divided between my sons and daughters Josiah Roberts, Benjamin Roberts, Susan Wheeler, Lucy Elliott and Amelia Burt. 2nd. I give devise and bequeath to my son Benjamin Roberts my land waterside premises and plantation on which I now reside, situate at Little Wild Cove Twillingate, together with dwelling house, stores stables outhouses, stage, flakes and every erection thereon with the exception of the house situate and standing on the south east corner of my premises to be hereinafter disposed of and all my gardens and meadows, with the exception of a small garden hereinafter mentioned to have and to hold the same for his own absolute use and benefit. 3rd I also give and bequeath to my son Benjamin Roberts one half of my land situate at Big Wild Cove, on the south side of the public road. Also one half of my land purchased from Albert Spencer, namely the western half more particularly described in a grant thereof No. 3626. I also give to my son Benjamin the whole of the land granted to me inside of Big Wild Cove Grant No. 5035. Containing two acres three roads and three perch more or less. 4th and I further give and bequeath to my son Benjamin Roberts the one half of my land situate namely the south side of the land described in a grant thereof No. 2685. 5th I give devise and bequeath to my son Josiah Roberts my fishing room and premises situate at Big Wild Cove Twillingate and all my lands connected therewith to the north east of the public road leading to Crow Head. I also give to my son Josiah Roberts one half of my land namely the north east side of the land granted to me in grant No. 2685 mentioned in the bequest to my son Benjamin Roberts the same being now in the possession of my son Josiah Roberts for his own absolute and benefit. 6th I give devise and bequeath to my daughter Lucy Elliott my fishing room and waterside premises purchased from William Shepperd and all erections thereon with the exception of the house formerly owned by George Milley, which is my sons Benjamins. I also give my daughter Lucy Elliott one half of my land namely the eastern half of my land described in Spencers grant No. 3626, and I further give to my said daughter Lucy Elliott the half of my land situate at Big Wild Cove, namely that half or part nearest to Edward Robert's land. And it is my will that these several lots of land so bequeathed to my said children shall be taken into their respective possession as soon after my decease as may be convenient for them so to do. 7th I give devise and bequeath to my daughter Amelia Burt, the land dwelling house store outhouses and plantation purchased by me from Wm J. Scott situate on Church Hill Twillingate and now in her possession. I also give my daughter Amelia Burt a small garden situate on my land at Little Wild Cove which she has occupied for some time past, bounded by land bequeathed to my son Benjamin and the Crow Head road with a right of way to the same To have and to hold the aforesaid bequests of land and property for her own absolute use and benefit. 8. I give and bequeath to my grand son William A. Roberts a dwelling house, now standing on the south east corner of my waterside premises, with permission to remove the same. I also bequeath to my said grandson William H. Roberts the sum of three hundred dollars, to my grandson Arthur Roberts two hundred dollars and to my granddaughters Lucretia Roberts and Olivia Roberts I give the sum of one hundred dollars each and it is my will that these several bequests to my said grandchildren be paid by my executors hereinafter mentioned after the decease of my wife Elizabeth Roberts, or sooner if my executors shall think proper so to do out of such monies as they may have in their hands or under their control. 9th It is my will and express desire that my money which I am now possessed of, and which is now out on loan at interest, on various securities, shall remain so, untill after the decease of my wife Elizabeth Roberts, and that the interest of such monies shall be annually collected by my executors, and applied toward the support of my said wife or so much thereof as shall be necessary for her comfortable maintenance. And further it is my will that any surplus sum of money so collected as before mentioned in the ninth clause of this my will and not required for the support of my wife Elizabeth Roberts the same shall remain in the hands of my executors upon Trust, until after her decease when my testamentary and other incidental expenses being first paid they my executors shall proceed to distribute my monied estate in the following manner, first by paying the several sums of money as bequeathed to my several grandchildren as mentioned in the eighth clause of this my will and the residue of my money or monied estate to be divided in the following manner that is to say. 10th To my son Josiah Roberts I give a one fifth part or share of all money or monies
of whatsoever kind or nature or wheresoever lodged and standing to the credit
of my estate at the time of the decease of my aforementioned wife, including
any monies or sum of money that my executors may be holding upon Trust. Lastly I nominate constitute and appoint my son
Benjamin Roberts and my son in law Alexander W. N.
Burt joint executors to
this my last will and testament. Dated at Twillingate this twenty fifth day
of January one thousand nine hundred and one. (Sgd) Francis Roberts (LS) January
25th A.D. 1901. I certify the foregoing to be a correct copy of the last will and Testament of Francis Roberts deceased D.
