Will of Richard Rhodes
from Newfoundland will books volume 4 pages 51-52 probate year 1879

In re
      Richard Rhodes deceased.

This is the last will and testament of me Richard Rhodes of St. John’s in the Island of Newfoundland Master Mariner    I hereby revoke all former wills and codicils ever by me made and appoint Gustav Ehlers of St. John’s Merchant and my uncle Richard Allan of Petty Harbour in the Island aforesaid to be the executors of this my will.    I give devise and bequeath all the lands goods chattels monies and property of whatever nature or kind soever and wheresoever situate and to which I shall be entitled unto at the time of my decease unto my executors before named upon the following trust viz upon trust to realize and invest the same or the proceeds thereof into Government or other good and sufficient security in the discretion of my said executors and to pay all the interest and profits arising therefrom unto my wife for the support of herself and the maintenance and education of such of my children as shall survive me; and so long as my said wife shall remain a widow, but in the event of the marriage or death of my said wife it is my will and desire that my executors do pay and apply the interest arising from my said property towards the support and education of my children until the youngest child shall have attained the age of twenty one years when I desire that my estate shall be realized and distributed rateably amongst my said children share and share alike The representatives of any deceased child or children dying and leaving lawful issue to receive their parents share.    Provided always and it is my will and desire that so long as my wife shall remain a widow and after the youngest child shall have attained the age of twenty one years she shall receive and take the interest arising out of my estate for her own use The sum of fifty pounds which I have invested in the Dock Company and the sum of twenty five pounds which I loaned to Mr. Goodfellow and which investment are in the name of my son Henry William I declare to be part and parcel of my estate and which I desire to have shared equally among my said children in manner aforesaid or charged to my said son in the distribution of my estate as to my executors shall deem best.    Dated St. John’s 4th day of August A.D.-1863.    Signed sealed published and declared in the presence of us as and for the last will of the said Richard Rhodes     R. Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation and also no paragraphs. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be. However, in some of the very long wills, we have tried to insert paragraphs to make it easier for the researcher to read the document.
