Will of Susan Rennie from Newfoundland will books volume 5 pages 1 to 9 probate year 1885

Last Will and Testament of Susan Rennie late of 15 Wellington Square Hastings in the County of Sussex Widow of David Stuart Rennie deceased.

This is the last will and testament of me Susan Rennie at present residing at 15 Wellington Square Hastings in the County of Sussex widow which I make as follows that is to say Whereas under the Will of my late husband David Stuart Rennie of Saint John's Newfoundland I am entitled to appoint two thirds of his real and personal estate among his Father's Children and grandchildren who may survive me and their heirs in such proportions as I may by my will direct and appoint Now therefore I do by this my will direct and appoint that the said two thirds of my said late husband's real and personal Estate shall go and be paid applied and transferred as follows that is to say in the event of William Frederick Rennie the only surviving son of my late husband's father surviving me then to such of the grandchildren hereinafter named of my said late husband's father as shall be living at the time of my death the sums hereinafter mentioned or an equivalent thereof in value that is to say

  • To David Rennie the sum of the said William Frederick Rennie the sum of one hundred pounds
  • To Mary Bowring daughter of the said William Frederick Rennie and wife of John Bowring of Liverpool the sum of fifty pounds
  • To Caroline Harvey daughter of the said William Frederick Rennie and wife of Richard Harvey the sum of fifty pounds
  • To Ellen Bogle daughter of the said William Frederick Rennie and wife of Andrew Bogle the sum of one hundred pounds
  • To Emma Hoyles daughter of the said William Frederick Rennie and wife of John Withers the sum of one hundred pounds
  • and to Jessey Rennie daughter of the said William Frederick Rennie and wife of Edward Rothwell the sum of fifty pounds
  • To William Frederick Rennie son the said William Frederick Rennie the sum of one hundred pounds
  • To Archibald McNabb Rennie son of the said said William Frederick Rennie the sum of one hundred pounds
  • To Robert Rennie son of the said William Frederick Rennie the sum of one hundred pounds
  • To John Bowring Rennie son of the said William Frederick Rennie the sum of one hundred pounds
  • To William Hugh Rennie son of the said William Frederick Rennie the sum of one hundred and fifty pounds

And subject thereto I appoint the same two thirds unto my brother-in-law the said William Frederick Rennie for his absolute use and benefit but in case the said William Frederick Rennie shall die in my lifetime I appoint thereout to such of the following children of the said William Frederick Rennie as shall be living at my decease the sums following or the equivalent thereof in value that is to say
To the said David Rennie the sum of three hundred pounds and to Each of them the said Mary Bowring Caroline Harvey and Jessey Rothwell the sum of two hundred pounds
And subject thereto I appoint the same two thirds unto and equally between such of the children of the said William Frederick Rennie (other than the said David Rennie Mary Bowring Caroline Harvey and Jessey Rothwell) as shall be living at the time of my decease

And I give and bequeath the following legacies videlicet
To my niece Robertha Wormwold Jagg the wife of the Reverend Frederick Charles Jagg the legacy or sum of one hundred pounds sterling
To my sister Mary Langworthy Wilson the legacy or sum of one hundred pounds sterling and in case of her death in my lifetime then such legacy to go to her son George Rennie Wilson
To my god-daughter Mary Hoyles Tozer wife of William Tozer Solicitor the legacy or sum of one hundred pounds sterling
To my godson Samuel Wilson Bickford Row (son of my executor hereinafter named) the legacy or sum of one hundred pounds sterling       I also give and bequeath to the said Samuel Wilson Bickford Row the ring engraved with the letter "R" and formerly worn by my late husband
I give and bequeath to Susan Amelia Archibald the daughter of the late Samuel Archibald of Halifax Nova Scotia the legacy or sum of twenty pounds and also my ring with the name "Susan" engraved on it
I give and bequeath to Mrs. Catherine Stewart widow of the late Edmund F. Stewart of Her Majesty's Customs the legacy or sum of ten pounds and to her daughter Catherine Mary Stewart an annuity of ten pounds to be paid to her half yearly during her life for her sole and separate use and benefit free from the control debts or engagements of her husband and her receipts alone notwithstanding coverture to be good discharge for the same the first half yearly payment of such annuity to be made at the expiration of six calendar months from my decease
I give and bequeath to my brother-in-law and executor Thomas Row my silver snuff box and to his wife my friend Susan Row my Coral Brooch (hips and haws) and Coral Cameo
I give and bequeath to my niece Anna Brown Stathem the wife of John Lee Stathem and formerly wife of Robert John Pinsent the legacy or sum of Fifty pounds and I direct that in case my said niece shall predecease me the legacy or sum of Fifty pounds hereinbefore given to her shall go to her said husband John Lee Stathem       I also give and bequeath to the said Anna Brown Stathem an annuity or yearly sum of fifty pounds to be paid to her half yearly during her life for her sole and separate use and benefit free from the debts control or engagements of her present or any future husband and her receipts alone notwithstanding coverture to be good discharges for the same the first half yearly payment of such annuity to be made at the expiration of six Calendar Months from my decease
I give and bequeath the legacy or sum of twenty pounds to Kate Pinsent the daughter of the said Anna Brown Pinsent Stathem by her former husband Robert John Pinsent
I give and bequeath to my friend and companion Anna Angel Bulley the legacy or sum of thirty pounds sterling and also an annuity or yearly sum of thirty-five pounds to be paid to her by equal half yearly payments the first of such half yearly payments to be made at the expiration of six calendar months after my decease       I also give and bequeath to the said Anne Angel Bulley all my wearing apparel and my best gold Portugal brooch and my writing desk with all its contents other than money or securities for money

I give and bequeath to Susan Row Hayward daughter of Augustus Olive Hayward one of my executors hereinafter named the legacy or sum of twenty pounds
I give and bequeath to Duncan Norton Taylor son of Captain Duncan Norton Taylor R.A. the legacy or sum of twenty pounds

And subject to the gifts and bequests hereinbefore contained I give all my Estate by real and personal to my trustees hereinafter named their heirs Executors Administrators and Assigns upon trust to sell and dispose of my said real and personal Estate and convert the same into money Either together or in parcels and Either by public Auction or by private Contract for the most money and best prices that can be reasonably obtained for the same. And I in particular direct the sale of so much thereof thereof as may not consist of money as may be necessary for the purpose of supplying the deficiency (if any) of my ready money available for the payment of the money legacies by this my will given and for providing funds whereout to pay the several annuities herein before given and with full power and liberty for the trustees for the time being of this my will to buy in and resell all or any portion of my said real and personal Estate (hereinafter Called my Trust Estate) at their or his uncontrolled discretion without being answerable for any loss occasioned thereby And upon sale of my said trust estate or any part thereof to convey assign and transfer the same to the purchaser or purchasers thereof and to give good and sufficient and effectual receipts releases acquittances and discharges to such purchaser or purchasers for his or their purchase money which shall effectually exonerate and exempt such purchaser or purchasers from the necessity of enquiring into the propriety regularity or expediency of any such sale or sales and from being affected by any impropriety or irregularity therein and from being answerable or accountable for the misapplication or non-application of the monies therein expressed or acknowledged to be received And I declare that my said trust Estate shall be considered in equity as converted from the period of my death and until the sale thereof the annual rents and profits arising therefrom and from every part thereof shall (subject to the gifts and bequests hereinbefore contained) be held and applied in like manner and upon the like trusts as are hereinafter declared with respect to the annual income arising from the proceeds of the sale thereof and from the stocks funds or securities in or upon which the same shall for the time being be invested
And I also expressly authorize and empower my said Trustees or Trustee for the time being in their or his sole and uncontrolled discretion to suspend the sale of all or any part of my said Trust Estate or the realization or conversion of any part thereof which at the time of my decease may be invested in securities of any other character than those hereinafter mentioned for such period or periods as they or he shall think fit And I direct my said Trustees or Trustee for the time being to lay out and invest the proceeds arising from any such sale or sales (subject nevertheless to the gifts and bequests hereinbefore contained) in the Government Stocks or Funds of Great Britain or at interest upon Freehold or long Leasehold securities in England or Wales with full power to lend on such freehold or leasehold securities such a proportion of their value as my Trustees shall think fit notwithstanding that the amount to be lent thereon may exceed what the Chancery Division of the High Court of Justice would consider the limit of what ought to be advanced thereon also to alter vary and transpose the same or any part thereof for or into any other securities of the like nature with those contemplated by this Trust and to stand possessed thereof and of all other my said Trust Estate (subject as aforesaid) upon trust in the first place to pay thereout my just debts funeral and testamentary expenses and the expenses of proving this my will and also all sums of money (if any) which at the time of my decease may be charged either legally or equitably upon my said Trust Estate or any part or parts thereof and subject thereto upon Trust to pay the dividends interest and annual income arising therefrom unto my said niece Robertha Wormold Jagg for her sole and separate use and benefit during her life free from the debts control or engagements of her present or any future husband with whom she may intermarry and her receipts alone notwithstanding coverture shall from time to time be good discharges for the same And from and after the decease of my said niece Robertha Wormold Jagg in case the said Frederick Charles Jagg shall survive her upon trust to pay to him the said Frederick Charles Jagg and his Assigns a moiety of such dividends interest and annual income during his life and subject thereto upon trust to pay transfer and divide my said trust estate unto and between all and every the children of her the said Robertha Wormold Jagg who being a son or sons shall attain the age of twenty one years or who being a daughter or daughters shall attain the age of twenty one years or marry in equal shares if more than one as tenants in common and if but one then to such one only
And lastly I appoint my said brother in law Thomas Row the said Frederick Charles Jagg and Augustus Olive Hayward of Saint John's Newfoundland Esquire Executors and Trustees of this my will In witness whereof I have hereunto set my hand this twenty second day of May one thousand eight hundred and seventy-seven-       Susan Rennie-       Signed by the said testator Susan Rennie as and for her last will and testament in the presence of us present at the same time who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses-
D. Hoadley Gabb Surgeon 18 Wellington Square Hastings-       Hannah Masey, Lodging House Proprietor 15 Wellington Square Hastings-

           This is a codicil to the last will and testament of me Susan Rennie widow of David Stuart Rennie now residing at 15 Wellington Square Hastings in the County of Sussex which was drawn by Messrs. Courtney & Croome Solrs Grace Ch. Street London and appointed Thomas Row Frederick Jagg and Augustus Olive Hayward as my executors (not having said will by me to refer I cannot give the date of its execution)       In addition to the bequests made in said will I give and bequeath to my faithful friend & companion Ann Angel Bulley an additional sum of fifteen pounds per annum to be paid to her half yearly the first payment to be made six months after my decease to be paid to her only during the term of her natural life afterwards to merge into my general estate for the benefit of my residuary legatee
I also give and bequeath to my niece Harriet Taylor wife of Captain Duncan Norton Taylor R.A. the sum of nineteen pounds ten shillings as a small token of my affection and regard I also give & bequeath to my niece Sarah Grace Hayward wife of Augustus Olive Hayward Q.C. of St. John's Newfdland the sum of nineteen pounds ten shillings as a small token of my affection and regard       Confirming all other bequests and appointments in my before mentioned last will and testament In witness whereof I the said Susan Rennie have to this codicil to my last will and testament set my hand this twenty second day of January in the year of our Lord one thousand eight hundred and seventy-eight-       Susan Rennie Signed and declared by the said Susan Rennie the testatrix as and for a codicil to her last will & testament in the presence of us who at her request in her presence and in the presence of each other (all being present at the same time) have hereunto subscribed our names as witnesses-
D. Hoadley Gabb Surgeon 18 Wellington Square Hastings-       H. Masey widow 15 Wellington Square Hastings.

           This is a second codicil to the last will and testament of me Susan Rennie which will bears date the twenty second day of May one thousand eight hundred and seventy seven Whereas by my said will I have given a legacy or sum of one hundred pounds sterling to my god-daughter Mary Hoyles Tozer who has since died Now I do hereby give and bequeath the said sum of one hundred pounds sterling to the Eldest daughter for the time being of her the said Mary Hoyles Tozer who may be living at the time of my decease for her absolute use and benefit In witness whereof I have hereunto set my hand this twenty fifth day of March one thousand eight hundred and seventy eight-       Susan Rennie-       Signed by the said testatrix Susan Rennie as and for a second codicil to her last will and testament in the presence of us present at the same time who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses-       D. Hoadley Gabb Surgeon 18 Wellington Square Hastings-       Fanny Thomson Nurse 12 Walden Grave Street Hastings-

           This is a third codicil to the will and testament of me Susan Rennie which will bears date the twenty second day of May one thousand eight hundred and seventy seven the first codicil bears date the twenty second day of January one thousand eight hundred and seventy-eight and the second codicil bears date the twenty fifth day of March one thousand eight hundred and seventy eight Whereas I have by my said will given & bequeathed to my niece Anne Brown Stathem an annuity or yearly sum of fifty pounds to be paid to her half yearly during her life And whereas the said Anne Brown Stathem has since the date and execution of my said will departed this life Now I do hereby give and bequeath the said annuity or yearly sum of fifty pounds to Catherine Pinsent (in the will called Kate Pinsent) the daughter of the said Anne Brown Stathem & her first husband Robert John Pinsent during her life or until she the said Catherine Pinsent shall become the inmate of a Roman Catholic Convent the said annuity to be paid to her half yearly and the first half yearly payment thereof to be made at the expiration of six calendar months from my decease Provided nevertheless that in case she the said Catherine Pinsent shall become the inmate of a Roman Catholic Convent or shall marry during the lifetime of her father Robert John Pinsent without his consent then & in either event the said annuity or yearly sum shall cease to be payable to her from the period of her becoming such inmate or the day of her marriage as the case may be and thereupon the said annuity or the fund from which the same shall be paid shall fall into and form part of my residuary estate And in all respects I confirm my said will and my said first and second codicils thereto       In witness whereof I have hereunto set my hand this fifteenth day of February one thousand eight hundred and eighty-four-       Susan Rennie-       Signed by the said testatrix Susan Rennie as and for a third codicil to her will in the presence of us present at the same time who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses-       D.
