Will of Thomas Quinlan from Newfoundland will books volume 2 pages 60-61 probate year 1851

In re
     Thomas Quinlan      deceased.

In the name of God Amen, the twentieth day of February one thousand eight hundred and thirty six.     I Thomas Quinlan of the Harbour of North Brigus Conception Bay, Cooper, being very sick and weak of body but of perfect mind and memory thanks be given unto God therefore calling unto mind the mortality of my body knowing it is appointed unto all men to die do make and ordain this my last will and testament, that is to say, principally and first of all I give and recommend my soul into the hands of almighty God that gave it and my body I recommend to the earth to be buried in decent Christian burial nothing doubting but at the general resurrection I shall receive the same again by the almighty power of God,
And as touching such worldly estate wherewith it has pleased God to bless me in this life I give demise and dispose of the same in the following manner and form:
First, I give and bequeath unto my grandson Patrick Shean and son of Thomas Shean my son-in-law now deceased, the dwelling house, garden and outhouse thereunto belonging.
Also I give and bequeath unto my grandsons Daniel Quinlan, John Quinlan, Patrick Quinlan and Peter Quinlan the swelling house, garden and outhouses with everything thereunto belonging to be equally divided among them, together with one half of the back ground and half of the waterside premises.
Also I give and bequeath unto my son Thomas Quinlan after the decease of my wife Elizabeth Quinlan, and not before, the dwelling house, garden and premises with the other half of the ground back of the house and half of the waterside premises.
I give also and bequeath unto my grand daughter Elizabeth Bryan and daughter of my son-in-law Daniel Bryan, Planter, the dwelling house, garden and premises occupied by him with everything else thereunto belonging.
I likewise constitute, make, or ordain Thomas Delaney my sole executor to see me decently buried and everything else property ordered, according to the true intent of this my last will and testament. And I do hereby utterly disannul, revoke and disallow all and every other form, testament, wills, legacies, bequests and executors by me in any way before named, willed and bequeathed, ratifying and confirming this and no other to be my last will and testament.
In witness whereof I have hereunto set my hand and seal the day and year above written.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
