Last Will and Testament of
Mogue Power of Torbay
Planter deceased.
In the name of God Amen The last
will and testament of Mogue Power of Torbay district of St. John's east Newfoundland
Planter Farmer made this second day of April in the year of our Lord one thousand
eight hundred and ninety four. I Mogue Power being very sick and indisposed
in bodily health but of perfect and sound mind and memory and calling to mind
that it is appointed for men once to die therefore I am desirous to settle
my worldly affairs and directing how the estate with which it has pleased God
to bless me with shall be disposed of after my decease therefore while I have
strength and capacity to do so - do make and publish this my last will and
testament hereby making null and void all other wills and testaments made by
me at any time heretofore
First I constitute my two sons Peter and
William sole executors of this my last will and testament desiring that they
shall settle all my just claims Also I do hereby will and bequeath to my son
Peter Power my homestead farm situated at Torbay aforesaid one dwelling house
barn and other outhouses furniture one horse car cart one pair wheels and the
farming implements to be used between my two sons Peter and William equally.
Further I do hereby will and bequeath my son William all the clear land and
all the land under fence occupied by me in motion to have and to hold the same
and his heirs.
Secondly I do hereby will and bequeath to my four
daughters Mary Catherine Ellie and Bridget and to my son William ten pounds
each in money Also my wife Catherine I do will and bequeath that she live with
my son Peter in the old homestead and have and keep whatever money is left
after paying my funeral expences and a burying lot in the new cemetery And
as a supplimentry I do hereby will and bequeath that when my two sons Peter
and William separates to divide whatever cow cattle is on the old farm between
them together with all the fishing gear and the wagon also to be used between
them and that is all.
In witness whereof I hereunto set my hand and
seal publish and declare this to be my last will and testament in the presence
of the witnesses named below the day and year above written. (Sgd) Mogue
his x mark Power. Signed sealed published and declared by the said Mogue
Power as and for the last will and testament in presence of us who in the presence
of him and in the presence of each other and at his request have subscribed
our names as witnesses hereto. (Sgd) John Roche (sgd) Patrick
Power.
I certify the foregoing to be a correct
copy of the last will and Testament of Mogue Power deceased
