from Newfoundland will books volume 7 pages 522 & 523 probate year 1905

Power Mary.       Last will of

In the name of God. Amen. I Mary power of St. John's widow of Joseph Power late of St. John's deceased being of sound and disposing mind, memory and disposition do make publish and declare this as and for my last will and testament. I give and bequeath to my executors hereinafter named all the property of whatsoever kind that I may die possessed of in trust for the following purposes

  • First to pay all my just debts and funeral and testamentary expenses
  • Second to pay one hundred dollars to the Roman Catholic Church for masses for the repose of the souls of my immediate relatives and myself such sum to be paid to such clergymen or clergyman of the said Church as my executors may in their discretion choose and for such of my said immediate relatives as my said executors may appoint.
  • Third To pay the sum of twenty dollars to Miss. Maggie Brown now of Keppi(?) Cove Bonavista Bay daughter of Thomas Brown deceased.
  • Fourth To pay to my brother James Brown of St. John's the sum of two hundred dollars.
  • Fifth To pay to John J. Rossiter son of Thomas Rossiter of St. John's deceased the sum of three hundred dollars.
  • Fifth (b) To pay to William Rossiter, brother of the said John J. Rossiter the sum of fifty dollars.
  • Sixth All the rest, residue and remainder of my estate including all moneys furniture and other property that I may die possessed of I give and bequeath to my sister Anne Rossiter widow of Thomas Rossiter, deceased. It being distinctly understood that the legacies set forth in the second third fourth fifth and fifth b paragraphs hereof to the Roman Catholic Church. Miss. Maggie Brown, James Brown, John J. Rossiter and William Rossiter respectively are made conditional upon my estate exclusive of my furniture being of the value of two thousand dollars at the time of my decease but should my said cash estate exclusive of said furniture be found to be less than two thousand dollars at the time of my death the the said legacies to the Roman Catholic Church, Miss. Maggie Brown James Brown, John J. Rossiter and William Rossiter shall be reduced to amounts bearing the same proportions to the said bequests made to them respectively as the said decreased value of my said cash estate bears to the sum of two thousand dollars. It is also my further will and desire that should my said estate be worth more than two thousand dollars at the time of my death then the said legacies to the said Roman Catholic Church, Miss. Maggie Brown, James Brown, John J. Rossiter and William Rossiter shall be of the amounts set forth in the said paragraphs second, third, fourth, fifth a and fifth b respectively and no more

I nominate and appoint my sister Anne Rossiter aforesaid and the said John J. Rossiter son of Thomas Rossiter late of St. John's deceased as executors of this my last will and testament and I hereby revoke and cancel all former wills and testaments and all documents of a testamentary character made by me at any time previous to the date hereof.
Dated at St. John's this sixteenth day of December Anno Domini one thousand nine hundred and three. Mary Power
Signed published and declared as and for her last will and testament by Mary Power in our presence and in the presence of each of us present at the same time who in her presence and at her request and in the presence of each other have hereunto signed our names as witnesses on the sixteenth day of December Anno Domini one thousand nine hundred and three     John J. Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
