Last will and Testament of
James Power of St. John’s
Cooper deceased
In the name of God Amen I James
Power of St. John’s Cooper do make publish and declare
this as and for my last will and Testament -
First I direct that all
my just debts funeral and testamentary expenses shall be paid.
Second.
I give devise and bequeath to my son John F. Power four
debentures of the Government of Newfoundland of the face value of four
hundred dollars each and of date the first day of July Anno Domini 1873.
Third. To my daughter Mary Kenny wife of James
Kenny of St. John’s Cooper
I give devise and bequeath four debentures of the Government of Newfoundland
of the face value of four hundred dollars each and of date the first
day of July Anno Domini 1873.
Fourth. To my daughter Eliza
Geran wife of Lawrence J. Georan of St. John’s
Gentleman I give devise and bequeath two debentures of the Government
of Newfoundland of the face value of four hundred dollars each and of
date the first day of July Ann o Domini 1873.
Fifth. I do will and declare
that the debentures so bequeathed to my said daughters and the moneys
thereby secured and all other benefits bequests or advantages which may
come to them or any of them under this my will shall be taken and held
by them and each of them as separate estate free and clear of the debts
liabilities and control of their hundreds.
Sixth. To my sons
William T. Power and Walter M. Power I give devise and bequeath the sum
of Fifty dollars each provided they claim the same within five years
from the date of my decease. And in the event of their or of either of
them not so claiming the same I will and desire that the said bequests
or such of them as may not be claimed within the said period of five
years shall be paid to my said daughter Mary Kenny.
Seventh. I give devise and bequeath to my Grand daughter Katie
Kenny daughter of my said daughter Mary Kenny the sum of Three hundred dollars
but upon and subject to the condition that she goes into and remains
during her lifetime in a convent in Newfoundland and not elsewhere. Should
she not fulfil this condition then the said sum of Three hundred dollars
shall be paid in equal shares and proportions to my said son John
F. Power and my said daughter Mary Kenny.
Eighth.
I will and bequeath the sum of four hundred dollars to be by my Executors
hereinafter named paid for Masses, including two high masses for the
repose of my soul and the souls of my wife of my father and mother and
of my deceased children.
Ninth
I give devise and bequeath to my said Executors the sum of Eighty dollars
to be by them paid in equal shares of Twenty dollars each to the convent
of St. Michael at Belvedere near St. John’s, to the Presentation
Convent at St. Patricks Riverhead St. John’s, to the Society of
St Vincent de Paul St. John’s and to the boys orphanage at Villa
Nova near Topsail.
Tenth. I do hereby nominate and appoint
my son John F. Power and my son in law James
Kenny as Executors of this
my will.
And lastly I do hereby revoke and annul all wills
by me heretofore made. Witness my hand at St. John’s this Twenty
ninth day of August Anno Domini 1890 (sgd) James Power. Signed by the
said Testator as and for his last will and Testament in our presence
who in his presence and the presence of each other have hereto set our
hands as witnesses on the day and year above written. (Sgd) Robert
J. Kent. (Sgd) Daniel M. Hogan.
I James Power of
St. John’s Cooper do make publish and declare
this as and for a codicil to my last will and testament as on the foregoing
pages of this sheet written I do hereby revoke annul and declare void
the bequest of twenty dollars to the Boys orphanage at Villa Nova near
Topsail in the ninth clause of said will contained being the share
payable under the said clause to the said Boys orphanage and I do hereby
ratify and confirm my said will in all other particulars. Witness my
hand at St. John’s aforesaid this 22nd day of March A.D. 1894. (Sgd)
