Will of Ellen Power

Last Will and Testament of
Ellen Power of St. John's
Widow deceased.

      This is the last will and Testament of me Ellen Power of Saint John's Newfoundland Widow. I hereby give devise and bequeath unto my daughter Mary Ellen Power at present residing in Boston U.S.A. the two houses belonging to me at Barnes Road, Saint John's and all other property both real and personal of which I may die possessed and I hereby appoint the said Mary Ellen Power Executrix of this my will. In witness whereof I have hereunto subscribed my hand at Saint John's aforesaid this sixth day of November A.D. one thousand nine hundred and one. (Sgd) Ellen Power. Signed published and declared by the said Testatrix as and for her last will on the day and in the year above written, in our presence who in her presence and at her request and in the presence of each other have hereunto subscribed ourselves as witnesses. (Sgd) William H. Horwood. (Sgd) George Hall.

Codicil

This is a codicil to the last will and Testament of me Ellen Power of Saint John's Widow. Whereas there is now due and owing by me a sum of money under mortgage upon the houses hereinafter mentioned I direct my executor to provide for the payment of the same and for this purpose to access each of the said houses with one half of the said amount. I give and devise to my daughter Ellen Power the house on Barnes Road (No 120) being the house at present occupied by me, the said devise being subject however to the payment by her the said Ellen Power of one half of the amount due by me upon the said mortgage at the time of my decease. I give and devise to my daughter Anne Shortall the house on Barnes Road (No 122) being the dwelling house at present in the occupancy of Sergeant O'Brien as and for her sole and separate property subject however to the payment by her the said Anne Shortall of one half of the amount due by me upon the said mortgage at the time of my decease. In all other respects I confirm and ratify my last will. In witness whereof I have hereunto set my hand at Saint John's aforesaid this twenty sixth day of February A.D. one thousand nine hundred and two and declare the foregoing to be a codicil to my last will and Testament. (Sgd) Ellen Power. Signed published and declared by the said Testatrix in our presence as a codicil as aforesaid who in her presence and at her request and in the presence of each other hereunto subscribe ourselves as witnesses. (Sgd) W. H. Horwood. (Sgd) Hugh W. Facey.

      I certify the foregoing to be a correct copy of the last will and Testament and Codicil of Ellen Power deceased
