Will of Eliza Power from Newfoundland will books volume 5 page 574-575 probate year 1891 Last will and testament In the name of God, Amen. I Eliza Power of Tilton Harbor, being sick of body but of sound disposing mind, and memory do hereby make this my last will and testament. First, I give and bequeath the remaining part of the money after defraying my funeral and other expenses, deposited by me in the Savings Bank in St. John's Nfld. to be equally and fairly divided between my husband Edward Power and my adopted daughter, Ann, one to have the same as the other. My husbands part is to remain in the Bank, and the interest to be paid him, as he may require it. The principal is not to be drawn on by him, except in case he may marry again, when he is to have full and sole control of it, immediately after his marriage, to do as he may think fit with the money. If he should die without contracting a second marriage, his part of the money is to go to my adopted daughter Ann, to be hers, wholly and entirely, Also, in case of sickness or ill health, or old age, or in the event of his leaving the country, he is to have a sufficient amount of the principal to defray his expenses, and maintain himself as he may require it. Secondly my adopted daughter Anne, is to have sole control of her part of the money, to be drawn by herself, and by no one else, without an order from her. It is my wish that she should be placed in the Mercy Convent, Kilbride St. John's, for two years, and the sum of sixty dollars per annum to be paid for her maintenance. In case she should die before my husband, Edward, he is to have the remaining part of her money, whatever it might be. This means of course, in the event of her dying unmarried; in case she should marry, she is to have full and entire control of her part of the money, to do as she may think fit. I also give and bequeath to my adopted daughter Ann my best silk dress and my sealskin cloak, and my two large trunks, to be hers solely and entirely Given under my hand, this 21st day of August, 1891.
