Will of Henry Pierce

In re
      Henry Pierce          deceased.

      I Henry Pierce of Goulds Road, in the electoral district of St. John’s West, Farmer being of sound and disposing mind memory and deposition, do make this my last will and testament:
First: I hereby revoke all former wills or testamentary papers made at any time by me.
Second: I direct the payment of all my debts and my funeral and testamentary expenses.
Third: I devise and bequeath to my wife Mary Jane Pierce all my land at Petty Harbor containing about one acre and all my land on the Goulds Road containing about ten acres together with the house thereon known as “Windermere House” and all other buildings and erections thereon and all the household furniture and effects therein and also all horses, cattle, farming utensils and implements and all other property of any kind whatsoever that I may die possessed of, for her sole use and benefit during her lifetime.
Upon the death of my said wife Mary Jane Pierce I will and desire that my said land houses and other property be distributed as follows:-

  • (a) To my daughter Fanny Williams the large Family Bible and one cow, said cow to be chosen by her from whatever cows are belonging to my estate at the time of the death of my said wife
  • (b) To my daughter Mary Ann Muggeridge, the bedstead known as number one bedstead with the bed and bedding thereof and one rocking chair and one chest of drawers.
  • (c) To my daughter Janet Pierce the piece of land situate at Petty Harbor and containing about one acre.
  • (d) All the rest of my said estate consisting of said land on the Goulds’ Road, said “Windermere House” said buildings and other erections said household furniture and effects, said horses, cattle, farming utensils, and implements and other property excepting those items of bequest to my daughters contained in paragraph a, b, and c preceding: to my son Kenneth Pierce for his lifetime,

After the death of the said Kenneth Pierce the property hereby bequeathed to him shall go to his children (if any) in equal shares and if the said Kenneth Pierce die without children then I will and desire that said property hereby bequeathed to him shall be sold and the proceeds thereof after payment of expenses of said sale shall be divided equally between my said daughters Fanny Williams, Mary Ann Muggeridge, Janet Pierce, and my daughter in law Harriet Pierce wife of said Kenneth Pierce share and share alike or to be divided equally between such of them as shall survive the said Kenneth Pierce if any one or more of them shall predecease him. It being always understood that in case of this last mentioned survivorship distribution or division the children of any one of my said three daughters shall if their mother be dead take their said mother’s share but should the said Harriet Pierce be not living at the time such division is to be made her next of kin or legatees shall have no interest whatever in said property or the division thereof.
I appoint Mary Jane Pierce my said wife sole executrix of this my last will and testament, Henry Pearce. Signed, published and declared as and for his last will and testament by the said Henry Pierce on the 18th day of May A.D. 1907 in our presence present at the same time who in his presence and at his request and in the presence of each other have hereunto our names subscribed as witnesses on the said 18th day of May A.D. 1907 Edward Murphy William R Howley.
