In re
MARTIN PHILLIPS.
DECEASED.
I, Martin Phillips, merchant, of Twillingate, in the northern district of
the Island of Newfoundland, being of sound mind and memory, do make and publish
this my last Will and Testament thereby revoking all other wills heretofore
made by me.
1st. I give, devise, and bequeath unto my wife, Dorcas Phillips, and my daughter
Maggie Anstey, nee Phillips, all my interest in the Union Trading Company,
and all the money I may die possessed of, together with such other monies as
may be derived from the sale of any property of mine after my death, to be
used co-jointly for their support and maintenance. But in the event of my wife
dying before my said daughter, then all my money unexpended by my said wife
and my daughter is to become the property of my said daughter, for her maintenance
and support, and after both my wife and my daughter's death, my grandchildren,
Lott and Martin are to have all my property. And all my daughter's children
are to have all my money, equally divided amongst them, after the death of
my wife and daughter.
2nd. I give and devise unto my beloved wife, Dorcas, and my daughter, Maggie,
my dwelling house, furniture, chattels, and storehouses, and shop and stock
in trade, and all my land, for their sole use and benefit. My said wife, however,
is to have full control of my dwelling house and household furniture, as long
as she lives; but, after her death, my said dwelling house and furniture, together
with all other property is to become the property of my daughter, Maggie.
3rd. I direct my said wife to sell all my interest in my fishing property,
of whatever kind, viz: my interest in half of two cod-traps and gear, and one
third of one trap motor-boat, skiffs and punts; and all money accruing from
the sale of the same is to be deposited in the bank, to the credit of my wife,
to be disposed of according to the preceding sections of this my last will
and Testament.
Lastly, I hereby nominate and appoint my wife, Dorcas Phillips and my daughter,
Maggie Anstey, nee Phillips, to be joint executrices of this my last Will and
Testament.
IN WITNESS WHEREOF, I have hereunto set my hand, this 15th day of March in
the year of our Lord, nineteen hundred and twenty-six.

CODICIL;
Whereas I, Martin Phillips, did on the 15th day of March in the year of Our
Lord nineteen hundred and twenty-six, make my last Will and Testament, I
do now by this writing add this codicil to my Will to be taken as part thereof:-
1st. I give and bequeath unto my wife, Dorcas Phillips, my gold watch and chain,
and to my daughter, Maggie, my organ.
2nd. I do now decree that my wife shall have all my property for her use, as
long as she lives. And, if my wife is in need, either my daughter, Maggie,
or her husband, is to contribute towards the support of my said wife, and in
consideration thereof my daughter is to have the remainder of my property at
the death of my wife. If, however, my said daughter, or her husband, fails
or refuses to properly contribute towards the support of my wife, whilst she
remains my widow. Then my said wife dispose of such of my estate as she may
need for her support and maintenance.
IN WITNESS WHEREOF, I have hereunto set my hand this 15th day of March A.D.
