      James Thomas Phillips.    DECEASED.

I, James Thomas Phillips, planter-fisherman of Twillingate, in the northern district of the Island of Newfoundland, considering the uncertainty of this mortal life, and being of sound mind and memory, do hereby make and publish this my last Will and Testament, thereby revoking all other Wills heretofore made by me.

1^st. I give, devise and bequeath to my beloved wife Phebe, all and singular my dwelling house, household furniture and effects, and all my land being and situated on the South Side of the Main Road, being part and parcel of my proportional part of the estate of my late father, James Phillips, to have and hold during her natural life. But it is my desire that after the demise of my said wife, the aforesaid property shall go to my beloved son, John Gordon Phillips, to do with, use and dispose of as he deems fit.

2^nd. I give and devise to my beloved son, Sidney Phillips, all and singular my right and title and interest in that certain piece of property, formerly part of the estate of the late Thomas Mitchard, purchased jointly by me and my said son Sidney.

3^rd. I give, devise and bequeath to my beloved sons, John Gordon Phillips and Sidney Phillips all my waterside premises, and all my fishing gear, motor-boat and engine, and all tools and other appurtenances whatsoever on the said premises. Also that piece and parcel of land situated on the South Side, near the Methodist Church which is one boundary of the same, the said land being also bounded by the Church Lane, and by the land of one George Hull. To them, my said sons, all and singular the aforesaid, jointly and forever.

4^th. To my beloved son, Sidney, I give and bequeath my sealing gun.

5^th. I give and bequeath to my beloved wife, Phebe, all my money that I have in the banks, to be hers during her natural life to draw therefrom such interest as may accrue annually from the same, for her support and maintenance. But it my desire that the principal shall remain intact. And after the death of my said wife, Phebe, the principal sum shall be divided equally, share and share alike, among our four children, whose names are, Sidney Phillips, John Gordon Philips, Mary Eliza Stuckless nee Phillips, and Minnie Phillips now residing at Toronto, Canada.

AND, IN CONSIDERATION OF THE PREMISES, it is my expressed desire and intention that my two sons, Sidney Phillips and John Gordon Phillips shall support and maintain in ease and comfort my said wife, Phebe, otherwise, for her support and maintenance, should it become necessary. I hereby empower and direct my executors of this my last Will and Testament to sell and convert into cash such of my property as they at any time deem necessary for the cause aforesaid.

Lastly, I do hereby nominate and appoint my son Sidney and my brother Martin Cooper Phillips to be executors of this my last Will and Testament.
