Will of James Philips

Last Will of James Philips late of
Twillingate, Planter, deceased.

      I James Philips of Twillingate (South Side) in the Northern District of the island of Newfoundland, being of sound mind and memory do make this my last will and testament in the manner and form following, that is to say,
1. I give and bequeath to my beloved wife Margaret Philips the interest of all my money at present deposited in the Banks in Newfoundland, or that may be deposited therein, for her support, so long as she remains my widow, said interest to be drawn annually.
2. I give and devise my dwelling house and furniture to my said wife for her use as long as she remains my widow. At the death of my wife or in event of her marrying again said dwelling house and furniture becomes the property of my son Joseph Philips.
3. I give and devise all my fishing room, fishing gear also my share in the schooner "Our Bobs" to my three sons James, Joseph & Martin Philips to be equally divided amongst them.
4. I give and bequeath my watch and chain to my son Joseph Philips a gun to each of my two other sons.
5. I give and bequeath all money owned by me, deposited in the Banks or elsewhere, after the death of my wife Margaret Philips, or in event of her marrying, to my three sons James, Joseph and Martin Philips and my two daughters Charlotte Poole and Mary E. Philips to be equally divided amongst the five. 6. I direct my executor hereinafter appointed to pay all lawful claims due by me out of the money that may be in my dwelling house or due me elsewhere at the time of my death.
And lastly: I hereby appoint and constitute Mr. Charles White (Teacher) to be the sole executor of this my last will and testament. My will is that the said executor shall not be required to give any bonds of or security to the court of Probate for the performance of his duty revoking and annulling all former wills by me made and ratifying and confirming this and no other, to be my last will and testament. In witness whereof I, James Philips, have hereunto set my hand and seal this eighteenth day of September in the year of our Lord one thousand nine hundred and one. James Philips (L.S.) Subscribed by the testator in the presence of each of us and at the same time declared by him, after being read and explained as his last will and testament who, at his request and in his presence have signed as witnesses of the same. - John Hodder. John W. Owen.

I, James Philips of Twillingate, do make and declare this to be a codicil to my last will which bears date September the 18th 1901. Whereas I have in and by my said will given and devised unto my three sons James Philips Martin Philips and Joseph Philips my share in the schooner "Our Bobs) to be equally divided amongst them I do hereby revoke my said will so far as it relates to the said schooner sec 3. And I no hereby give and devise unto my son Joseph Philips one half of my share in the schooner "Our Bobs" and the remaining half to be equally divided between James Philips and Martin Philips my other two sons. And in all other respects, I confirm my said will. In witness whereof I hereunto set my hand this twenty second day of October 1901. James his x mark Philips. Signed by the said testator by making his mark after being read and explained, as a codicil to his last will in our presence, who in his presence and the presence of each other at the same time subscribed our names as witnesses of the same.       I certify the foregoing to be a correct copy of the last will with one codicil thereto of James Philips
