Will of James Phelan from Newfoundland will books volume 5 page 504-505 probate year 1890 Last will and Testament I James Phelan of St. John's Newfoundland Grocer hereby declare this to be my last will and Testament revoking all wills by me at any time heretofore made. First. I direct that all my just debts and funeral expenses be paid by my executors hereinafter named. Secondly. To my beloved wife Johanna I give and bequeath all my stock in trade household furniture and goods of every description in my dwelling house. It is my wish that my business be carried on by her under my name. I also give and bequeath to her the house owned by me on Brazils Square and also my interest in a mortgage which I have in two houses situate in Lazy Bank. Thirdly. The land which I am possessed of on the Topsail Road I give and devise to my son John. Fourthly. To my executors in trust for my two daughters Minnie and Bridie when they shall attain the age of twenty one years I bequeath all my shares in the Union Bank to be equally divided between them. Fifthly. To my executors in trust for my son James to be paid to him on his attaining the age of twenty one years. I bequeath the sum of twelve hundred dollars which amount is at present in Commercial Bank. Sixthly. Out of the moneys in my safe I direct that my executors invest the sum of twelve hundred dollars for my son William and pay over the same to him on his attaining the age of twenty one years. Seventhly. To my father and mother I bequeath the sum of four hundred and eighty dollars. All the rest and residue of my property of every description I bequeath to my beloved wife. I hereby nominate and appoint the Reverend William Shaw of St. John's and my brother-in-law Michael Tobin executors of this my will. St. John's December 22nd 1889. James his x mark Phelan Signed by the said testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereto subscribed our names as witnesses (the same having been first read over and explained to said testator) Michael Tobin M.
