Will of James Peyton
from Newfoundland will books volume 6 pages 301-302 probate year 1896

Last Will and Testament of
James Peyton of Twillingate N. D.
Carpenter deceased.

      In the name of God Amen. I James Peyton of Peach Harbour, Twillingate do make this my last will and Testament of which I hereby appoint William Baird and Frederick Stafford M.D. joint Executors.
1. I give and bequeath to my wife Ann Peyton such monies as I am possessed of at my death, also whatever interest I have in the dwelling house where we have lived and the land around it for her sole use and benefit. I also give her the back potato garden, mentioned in my father's will. I further give the said Ann Peyton my cow, milk house, and store, which two later buildings she may remove or sell if desirous at any time of doing so. I further give her all my household furniture, beds and bedding and a book case which stands in the parlour (but not the books) also a case of liquor bottles. I further give her one herring net (value $20) Twenty dollars) now lying in my workshop.
2. I give and bequeath to my nephew William Peyton my said workshop and carpenters and agricultural tools as well as other implements found there (save only the herring net above mentioned) I further give him my late father's watch chain and seal with crest which I desire shall not go out of the family. And these bequests I make him solely in the hope and confidence that he will give such assistance to his aunt when she shall become my widow, as he may be able to do without undue injury to himself.
3. I give to my nephew James Archibald Stirling Peyton one gold seal with motto upon it.
4. I bequeath all the books in my bookcase to be divided between my nephews Henry William, Archibald, Edgar and Augustus Peyton equally or otherwise as they shall agree among themselves. Codicil (a) Under heading 2 read my nephew William Peyton son of Elias Peyton. Signed by the Testator and in the presence of the same witnesses this Twenty third day of November 1894. (Sgd) James Peyton (LS) Witness (sgd) Robert Temple. (Sgd) Mary Ann Pride

Codicil (b) Under heading 4 read. All my printed reading books and my bookcase to be divided by my wife between my nephews Henry, Edgar, and Augustus Peyton sons of Thomas Peyton and William and Archibald sons of Elias Peyton in such manner as she shall consider just and right. Signed by the Testator and in the presence of the same witnesses this Twenty third day of November (sgd) James Peyton (LS) witnesses (sgd Robert Temple (sgd) Mary Ann Pride
